This confirms your meeting on April 23, 1996, with Mr. Ernest Jahnke of
my Wilmington Regulatory Field Office staff and me at your home at 249 Bayview
Boulevard, Atlantic Beach, Carteret County, North Carolina. The purpose of
the meeting was to discuss the unauthorized extension of your pier and the
construction of a boat lift into the Federal channel and the channel setback
of a manmade canal off Bogue Sound. This work is a violation of your
Department of the Army (DA) permit issued May 23, 1973, and Section 10 of the
Rivers and Harbors Act of 1899.
Specifically, your permit authorized the construction of a 16 feet long
(pier with a 5 feet long by 16 feet wide pile supported deck. Measurements of
the pier confirm that it is 57 feet long of which 25 feet is in the 25-foot
channel set back and 11 feet extends into the channel proper. The footprint
of the boatlift extends 5 feet into the channel with the remaining 9 feet
-situated within the channel setback.
You may comply with the Federal channel restriction by removing 1JAt
of the pier from its waterward end and 5 feet from the waterward side o
boat lift (Figure 1). Full channel setback compliance must be achieved
to the next channel dredging. We will notify you prior to this action.that time, the remaining 25 feet of the pier must be removed and the enboat lift must be relocated landward of the 25-foot setback line.
Alternatively, you may wish to bring these structures entirely into compat this time by removing 36 feet of the pier and relocating the entire b
lift landward of the 25-foot setback (Figure 2).
You should confirm your agreement and understanding of this directive in
writing within 30 days of your receipt of this letter. At a minimum, you must
complete the channel compliance remediation as illustrated in Figure 1 within
3 months of the date of this letter. Failure to do so may result in referral
of this matter to the US Attorney for appropriate legal action.

Dear Mr. Tippett,
Today I received the U.S. Army Corp of Engineer's decision in regards to the
unauthorized pilings set in the Estuarine Water and Public Trust Area, both CAMA Areas of
Environmental Concern, adjacent to 249 Bayview Blvd. in Atlantic Beach. Based on a violation
correspondence, the Corp is requiring the removal of all pilings not referenced in the May 20,
1996 letter signed by Clifford Winefordner. As a result, this restoration will not only be the
removal of the two pilings noted in CAMA violation #02-34C but the two pilings directly south.
I am forwarding you a revised restoration agreement as well as the aforementioned
correspondence received from the Wilmington District Corp Office. If you agree to remove the
referenced pilings, please sign the revised restoration plan and return it to this office in the self
addressed envelope within 10 days of receipt of this correspondence. Failure to comply with this
request or respond back to this office prior to the requested deadline with an acceptable schedule
for compliance will be interpreted as a refusal to cooperate and will result in a Notice of
Continuing Violation, as well as a court injunction being sought ordering compliance.
The relevant statutes and regulations are available from this office, and I am willing to
assist you in complying with the requirements of these laws. If you have any questions regarding

I, George Tippett agree to provide a plan view drawing showing the unauthorized
development and how the docking structure will accommodate vessels. This drawing should
include distance across the waterbody and the distance from the bulkhead to the existing as
well as new development. I understand that this documentation will then be used to
determine if the structures can remain through consultation with the US Army Corp of
Engineers. If the development is found to be inconsistent I agree to remove the unauthorized
development.
I agree to complete this restoration to the satisfaction of the Division of Coastal Management
by 16 August 2002 or provide an explanation for non-compliance and a reasonable request
for time extension.

It is the policy of the Coastal Resources Commission to levy at least a minimum civil
assessment of $200.00 against all violations. If restoration of the affected resources is not
undertaken or completed satisfactorily, a substantially higher civil assessment will be levied
