I was very disappointed to hear that your organization does not consider the safety of abutting property owners and boaters in the relevant area when reviewing this type of application. 1. Mr. Schmidt operates a "marine service" out of his property in violation of the deed restrictions of the development in which he lives. This mooring piling will become part of that business and tether either his own derelict boat(s) or those of others. This is likely to include boats of poor repair and poor seaworthiness resulting in potential danger or harm to property owners and boaters in the area. 2. Mr. Schmidt owns a number of derelict boats which he keeps on his property. These boats are of questionable seaworthiness (I've been boating for over 40 years) and are likely to represent both a safety hazard as well as an environmental hazard resulting from the spilling of hazardous materials. 3. Given these safety and environmental concerns, I question the enforceability of the limit of 1 skiff only on the mooring. 4. The common property line has not been surveyed. Mr. Schmidt recently purchased a small strip of land between our properties. I hope that CAMA will require that the property line be surveyed to ensure that Riparian rights are not infringed upon. In the past, Mr. Schmidt has been required by Crayton Bay Property Owners Association to cease using property that was not his. I am concerned, therefore, that a survey should establish the pertinent property line from which the offset would be measured. I understand from our conversation that these safety and environmental issues are not pertinent to your consideration of this application but wanted to express my disappointment at your position nevertheless.
