Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officerwhen the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. We propose to dredge approximately 189 cubic yards of material and store it temporarily on the grassed area a minimum of 35 feet north of the mean high water of Taylor's Creek and south of the existing Front Street pavement as shown on the attached Plan and Section. As part of this operation we will also extend the existing 18" storm drainage pipe to be flush with the proposed bulkhead. Upon completion of the construction of the bulkhead, the stockpiled material will be used as back fill for the bulkhead. During construction of these facilities and dredging the contractor will follow all applicable sedimentation and erosion control regulations. Enclosed you will find the following permit application documentation: 1) Vicinity Map 2) Plan — showing the limits of the proposed dredging, the proposed bulkhead, and stockpile area 3) Section — Showing the limits of the proposed dredging 4) Adjacent Riparian Property Owner Statement — Copy of letter from your file dated June 2006 signed by the two subject property owners, Mr. C. Two trees are totally undermined and several are only partially stable. The area under the dock and walkway has eroded even more than the surrounding area. If the trees are lost, the grassy area will become even less stable. SITE EVALUATION: The shoreline west of the dock and walkway has marsh grass from the water's edge to the slope of the grassy plot and the trees and shoreline appear relatively stable. The shoreline east and beneath the dock and walkway is severely eroded. Three trees are strapped together in an effort to save the most endangered trees. An area of bare sand between the slope and existing marsh grass east of the dock and walkway ranges from about one foot to as much as four or five feet wide. There are several small areas of rip -rap already in position, one at the edge of the Wheatly property and boat ramp, and one on each side for several feet immediately to the east and west of the walkway. If rip -rap could be placed to the shore side of the marsh grass at the east, and if sand could be deposited in the resulting barrier, perhaps the more stable trees could be saved, the be shoreline could'be retained, and re -silting of slips 7 and 8 could slowed.
