Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

This letter is in response to your correspondence, which was received by the N.C. Division of
Coastal Management on July 23, 2008 and August 5, 2008, regarding your concerns about the
proposed development by Winston Henderson, at 93 East 2nd Street, Ocean Isle Beach, adjacent
to a man-made canal, in Brunswick County. The project consists of maintenance excavation of
approximately 97 cubic yards of spoil material and the installation of a pier and floating dock.
The proposed project has been determined to comply with local regulations and the Rules of the
Coastal Resources Commission (15A NCAC 07H .1500 General Permit for excavation within or
connecting to existing canals: channels: basins or ditches in Estuarine Waters: Public Trust
Waters: and Estuarine Shoreline AEC'S and 15A NCAC 07H .1200 General Permit for
construction of piers, docks, and boat houses in the Estuarine Shoreline AEC), and as such, a
permit has been issued to authorize the development. I have enclosed a copy of the permits, as
well as, the applicable rules.
If you wish to contest our decision to issue this permit, you may file a request for a Third Party
Appeal. The Chairman of the Coastal Resources Commission will consider each case and
determine whether to grant your request to file for a Contested Case Hearing. The hearing
request must be filed with the Director, Division of Coastal Management, in writing and must be
received within twenty (20) days of the disputed permit decision. I have enclosed the applicable
forms and instructions that must be filed prior to that deadline. Please contact me at (910) 796-
