Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. 1) The docking facility and associated structures shall have a minimum setback distance of 15' between any parts of the structure and the adjacent property lines as extended perpendicular to the channel into the water at the points where the intersect the shoreline (The riparian corridor in which construction may take place is depicted in the revised 3/3/92 survey by J. R. Coston for Charles C. K. Lee). 2) No sewage, whether treated or untreated, shall be discharged at any time from boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 3) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31 1995 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. PROJECT SUMMARY: The applicant proposes to construct 4 finger piers and slips for charter boat operation behind applicant's bait and tackle shop. FIELD INVESTIGATION REPORT - CAPT. JOE SHUTE'S BAIT & TACKLE (JOSEPH SHUTE), CARTERET COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: The applicant's property is a .5 acre tract located at 131-5 Morehead Avenue (Beach Causeway), on Moonlight Bay, in Atlantic Beach, Carteret County. A 141' x 53' two-story block building with several sub -offices exist on the property. There is also an existing L-shaped dock with 4 slips (authorized under a CAMA Exemption in 1986) behind the building in Moonlight Bay. The applicant has leased space in the building for a bait and tackle shop and has also leased the dock from which he proposes to operate a charter boat fishing business. The applicant proposes to improve the existing dock by constructing four (4) 18' x 2' finger piers and extend the existing mooring pilings 4' waterward. Water depths in the vicinity of the dock range from -1' to -6' MLW. The applicant proposes to locate six (6) parking spaces outside of any AECs. A Major Permit is required for this project due to the change in use of the dock from personal to commercial. 10. ANTICIPATED IMPACTS: The waters of Moonlight Bay are closed to shellfishing by the Division of Environmental Health and Division of Marine Fisheries and are classified as 'SA' by the Division of Environmental Management. The proposed finger piers will occupy an additional 36 sq. ft. of Public Trust Waters. The environmental impacts are anticipated to be minimal. PREPARED BY: W. No other structures, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 4. The docking facility and associated structures shall have a minimum setback distance of 15' between any parts of the structure and the adjacent property lines as extended perpendicular to the channel into the water at the points where they intersect the shoreline. 5. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6.
