Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

RE: Objections to the Issuance of General Permit to Construct a Pier and Platform
Dear Mrs. Godfrey:
This letter is in reference to your correspondence objecting as an adjacent riparian property owner
to a request from James Chen to construct a pier and platform on the east side of his bulkhead
along the Albemarle Sound. Kelly Russell of the Division of Coastal Management staff was
recently on site and reviewed the proposal and found it consistent with T15A, Section 07H .1200:
General Pen -nit for Construction of Piers, Docks, and Boat Houses in Estuarine and Public Trust
Waters and Ocean Hazard Areas (Enclosed).
The Division of Coastal Management has given your objections careful consideration and has
determined that the project, as proposed, is consistent with the appropriate rules and regulations.
The Division issued General Permit 950520A on June 16, 2008, to Mr. Chen (See Enclosed
Permit). The placement of the pier and platform will be in compliance with the Division's
standards or Mr. Chen will be required to correct or remove the structure.
If you wish to request an appeal of this decision, you may file a request with the Director of the
Division of Coastal Management, Department of Environment and Natural Resources within
twenty (20) days of the permit decision. If you have any questions regarding this matter please
