Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Dear Mr. Costa:
This letter is in reference to CAMA General Permit No. 34246-D, issued to you on
October 28, 2003, for the construction of a private pier (6' x 372') and floating dock (6' x
20') at your property located at 315 Windy Hills Dr. (as per New Hanover County Tax
Office), in Wilmington, New Hanover County. This permit was issued based on
information you supplied to the Division of Coastal Management regarding riparian
corridor boundaries.
Based upon recent information brought to the attention of the Division of Coastal
Management, it appears that a riparian corridor had already been established for that
area of the shoreline, and was pre-existing prior to the time that you received your
CAMA General Permit No. 34246-D. The riparian corridor in question was originally
established on September 7, 1999, and is shown on the Hobbs Surveying Company,
Inc. survey dated September 24, 2003. The Hobbs survey indicates the location of
Mean High Water (MHW) and the appropriate riparian corridor, as determined by the
Division of Coastal Management in conjunction with New Hanover County Zoning on
September 7, 1999 (copy enclosed).
Under these circumstances, the Division of Coastal Management is suspending CAMA
General Permit No. 34246-D so that we can issue a new or revised permit in conformity
with the pre-existing northern riparian corridor line. The permit will remain suspended
until the Division issues a new or revised permit. You are requested to submit to the
Division a revised drawing of your proposed pier and floating dock indicating the
appropriate changes. The changes will likely result in the entire pier being moved south
approximately 2.5 feet and the floating dock being set back to meet the 15 foot setback
from the southern riparian corridor line, unless you are able to secure a waiver from the

riparian property owner to the south of your property. Without a waiver, you may have
to reduce the overall square footage of the floating dock or reconfigure the floating dock
to meet the required setback.
I request that you contact Mr. Jim Gregson, District Manager for the Division of Coastal
Management in the Wilmington Regional Office at (910) 395-3900 ext. 251, indicating
your intentions to comply with the request specified herein. You will also need to re -
notify the adjacent riparian property owners by sending the notification form and revised
drawing to them. Lastly, you will need to schedule a pre -application meeting with the
Local Field Representative prior to obtaining a revised and/or new CAMA General
Permit.
