Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistentwith the North Carolina Coastal Management Program.

Re: Objection to the Issuance of General Permit 15 A, NCAC 07H.1100
And 07H.1200, Ed Carr, 1442 Duck Road, Dare County
Dear Ms. Beacham and Ms. Pulley:
Your December 11, 2003, response as an adjacent riparian property owner objected to
a permit request from Ed Carr of 1442 Duck Road, Duck, Dare County. He seeks a
permit to construct a bulkhead as shoreline stabilization, and pier structures along the
shoreline of his property on the Currituck Sound. Dennis W. Hawthorn of the Division
of Coastal Management staff was recently onsite and has staked a bulkhead alignment
that is directly adjacent to the existing erosion escarpment that will not result in any fill
of any wetland areas, or the waters of the Currituck Sound. Mr. Hawthorn noted that
this bulkhead structure will extend north to south along the shoreline for a distance of
approximately 116 feet. The proposed pier walkway will extend from high ground on Mr.
Carr's property 50 feet into the Currituck Sound. The pier will include a 10 feet long by
12 feet wide platform at the end, with a boat lift on the north side of the platform.
Mr. Hawthorn reviewed all aspects of this proposal for consistency with 15A NCAC,
Subchapters 07H.1100 and 07H.1200. These are the rules that apply to the placement
and construction of the proposed bulkhead and pier. Mr. Hawthorn has reviewed your
objection noting that you need much more information. This review has found that the
drawing attached to the notification form provided all of the needed information to
determine that the proposed development is consistent with NCAC Subchapter
Sections 07H .1100 and 07H.1200.
Having given your objections to this proposal careful consideration, I have determined
that the proposed project is consistent with the appropriate rules and regulations and
that all pre -requisite requirements have been satisfied. The Division intends to issue
General Permit #A36006 (copy attached) for the proposed development on January 23,
2004.

1442 Duck Road, Duck, Dare County, to construct a bulkhead as shoreline stabilization
along the shoreline of his property on the Currituck Sound. Dennis W. Hawthorn of the
Division of Coastal Management staff was recently onsite and has staked a bulkhead
alignment that is directly adjacent to the existing erosion escarpment that will not result
in any fill of any wetland areas, or the waters of the Currituck Sound. Mr. Hawthorn
noted the proposed pier walkway will extend from high ground on Mr. Carr's property
50 feet into the Currituck Sound. The pier will include a 10 feet long by 12 feet wide
platform at the end, with a boat lift on the north side of the platform. Mr. Hawthorn
noted that this bulkhead structure will be aligned north to south along the shoreline for
a distance of approximately 116 feet.
Although you have indicated concern regarding the use of bulkhead return walls,
typically this technique of construction is standard for bulkhead construction, and is
consistent with our rules concerning bulkhead construction so long as the structures
will be located entirely on the permittee's property. We have also noted that you have
suggested the use of riprap rock in the 15 feet setback area. It is my understanding
that Mr. Hawthorn recently spoke with Mr. Carr about the possible use of this material
in some fashion to reduce any increased erosion potential on the neighboring property
shorelines. Mr. Carr indicated during this conversation that he wished to be a good
neighbor, and that he may pursue the use of riprap rock material at a later time through
an additional permit.
