Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistent with the North Carolina Coastal Management Program.

LICENSE AND HOLD HARMLESS AGREEMENT
This Agreement is entered into this / s i, day of 2004 between the Town
of Cape Carteret, a municipal corporation duly organized and existing under the laws of the State
of North Carolina (the Town), Dobkins-Krieger Marine, Inc. a North Carolina corporation,
(Contractor) and Richard H. Whitaker, Jr. and wife Rebecca P. Whitaker (Owner).
WHEREAS, the Town has undertaken to repair a washout area (washout) at the location
where a drainage culvert runs under Yaupon Drive approximately one -quarter mile from the
intersection of Yaupon Drive and W. B. McLean Drive, also known as N.C. Highway 24 in the
Town of Cape Carteret; and,
WHEREAS, the Town has entered into an agreement with Contractor for Contractor to
perform the work to repair the washout and,
WHEREAS, Owner owns property adjacent of the site of the washout and,
WHEREAS, Town and Owner recognize the mutual benefits of the Towns causing the
washout to be repaired in that the erosion of the area around the culvert is likely to spread onto
Owners property if the repairs are not made; and,
WHEREAS, the damage could extend to the bed and surface of Yaupon Drive if not
corrected;
NOW THEREFORE, the parties agree as follows:
1. Owner hereby grants to Town and Contractor a License to enter upon the lands of
Owner adjacent to the culvert and washout area with such equipment and workers as may be
necessary to repair the washout area as shown in Contractors proposal to Town, a copy of which
is attached hereto and incorporated herein by reference.
2. Contractor and Town represent that the repair will be done in substantial conformity
with the attached proposal to the extent that substantial conformity is possible, all parties
agreeing that the ultimate purpose of Contractor is to effect a safe and effective repair of the
washout area.
3. Town and Contractor agree that after the washout area is repaired that Town and
Contractor will leave Owners property in the same or better condition as when this agreement
was executed.
4. All parties hereby release all other parties from any liability for personal injury or
property damage except as specifically provided herein or by other applicable law (e.g., The
North Carolina Workers Compensation Act).
WHEREFORE, the parties have executed this Agreement the day and year indicated
above.

WHEREAS, Owner owns property adjacent of the site of the washout and,
