Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certifythat this project is consistentwith the North Carolina Coastal Management Program. The extension of the existing 74' pier and addition of a platform as proposed is consistent with North Carolina Administrative Code 07H.1200 (see attached) and the appropriate rules and regulations of the Division. Therefore, on 17 June 2004, R. Kelly Spivey, a member of my staff, issued General Permit No. 38614-B authorizing the aforementioned project (copy of permit attached). If you wish to appeal this permit decision, you may file a request with the Director of the Division of Coastal Management, Department of Environment and Natural Resources within twenty (20) days of the permit decision. Division of Coastal Management 943 Washington Square Mall Washington, NC 27889 Dear Mr. Moore, I received a letter from Mr. Marshall Askew of 334 Tuscarora Beach Road in Winton, NC. I am an adjacent riparian landowner at 338 Tuscarora Beach Road. According to Mr. Askew's letter, he wants to extend his existing pier 91 ft. with a platform on the end. I feel that this would be a nuisance to our property and rights as a landowner. It also could depreciate the value of my property as being an obstruction. Being as close as it is, Mr. Askew's extension will be an obstruction to our waterfront property. Any boats docking or leaving from our property will have to work around his pier. With a boat ramp on his side of our property, it would inhibit us from loading and unloading our boats freely. On a typical weekend, we may have five to eight boats moving in and out. I feel that with the amount of boat traffic we have, the extension would limit the access to our boat ramps. Also, this will obstruct water skiers from dropping at the end of our pier as they normally do. Anyone skiing will not be able to stop at the end of our pier anymore. Consequently, they would have to be dropped further out and have to swim in to the pier. This would not be safe with the boat traffic on the Chowan River. With these and several other concerns leaves me no choice but to object to Mr. Askew's 91ft. extension to his pier. I feel it would affect the water traffic and safety of our boaters. Hopefully you would take this into consideration and not permit him to extend his pier. Sincerely, David L.
