Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythatthis project is consistent with the North Carolina Coastal Management Program.

The purpose of this correspondence is to clearly communicate to you that you are expected to comply with
the riparian buffer rules. Your project is located within the Tar —Pamlico River Basin and is thereby
subject to North Carolina Administrative Code Title 15A NCAC 02B .0259, which describes the
regulations for the protection and maintenance of existing riparian buffers.
Your Coastal Area Management Act (CAMA) permit, issued to you by the Division of Coastal
Management (DCM), allows for the installation and construction of your project. However, there are
buffer regulations for streamside (riverside) buffers and buffers adjacent to coastal wetlands that also
apply to your project. The Division of Water Quality (DWQ) administers these buffer regulations.
Authorization by the DCM is not a riparian buffer authorization.
The land disturbance, grading and the removal of vegetation necessary to gain access to construct
your shoreline stabilization project must be restored to its original vegetative condition. Because the
pre-existing condition of Zone 1 of the riparian buffer for this site was wooded, the site must be replanted
with a minimum of two native tree species at stem density of 320 trees per acre, and then left in an
undisturbed state. If any trees currently on -site die as a result of the construction practices, they too must
be replaced.
Specifically, construction activities must comply with following:
Minimize the removal of woody • Restore the area of disturbed riparian buffer
vegetation
• Minimize the extent of the disturbed • Construction corridors are allowed for construction but
area they must be satisfactorily restored
• Minimize the time in which the areas • Appropriate restoration must be completed by the first

remain in a disturbed state (bare

subsequent planting season (November 1 through
March 1) for woody vegetation
According to the DCM permit, 160 linear feet of shoreline was disturbed during the construction that
equates to 4,800 ft' of Zone 1 disturbance. This equates to a minimum of 35 trees that must be replanted
in Zone 1 to restore the riparian buffer. Please refer to the Guidelines for Riparian Buffer Restoration
provided online (http://www.nceep.net/news/reports/buffers.pdD for assistance.
Re -planting of vegetation must occur within the soonest available planting season. If the restoration is not
completed within this timeframe, this office will issue a Notice of Violation with Recommendation for
Civil Penalty Assessment. Please be aware, violations of these regulations may result in civil penalty
assessment of up to $25,000 per clay per violation.
