This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian

Morehead City DCM
Mr. and Mrs. Vitak have retained Coastal Planning Services, Inc. to provide CAMA permitting assistance for
improvements to their property located at 503 Neptune Drive in Cape Carteret. Construction of a residence,
authorized by minor CAMA permit WO-59-06, is currently underway. Mr. and Mrs. Vitak previously received
approval from Carteret County to modify the existing minor CAMA permit (WO-59-06) to construct a keystone
retaining wall and associated grading in conjunction with this project.
Additional improvements proposed at this time include excavation of a high -ground basin and access channel from
the existing canal, construction of a bulkhead, and installation of a boatlift. Enclosed are project drawings showing
the proposed work, calculated excavation volumes, and documentation of notification to the adjacent property
owners.
Mrs. Peggy McQueen, who owns the property to the east, did not provide any written objections or statement of no
objection to the project. A follow-up phone conversation with Mrs. McQueen confirmed that she had no objections.
Mrs. Lura Fulcher, owner of the property to the west, objected to the project. Included is a copy of her written
comments.
Also included is Coastal Planning Services, Inc. check #1197 in the amount of $800.00 to cover application fees for
general permits for excavation, installation of the boatlift, and construction of the bulkhead. A copy of the minor
permit modification and Mr. Vitak's letter authorizing me as his agent are also included.

Cape Carteret, as requested in the permittee's application, dated 11/09/06. This permit, issued on 11/22/06, is subject
to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and
special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment
or civil action, or may cause the permit to be null and void.
This permit authorizes: Construct single-family dwelling, driveway, retaining wall and backfill wall.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on 11/09/06.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.

(5) The amount of impervious surface shall not exceed 25% of the lot area within 575 feet of Normal High Water
(Estuarine Shoreline - ORW Area of Environmental Concern), in this case, 7,018 square feet is authorized.
(6) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all
development/construction shall be located a distance of 30 feet landward of Normal High Water. No portion of the
roof overhang shall encroach into the 30 ft. buffer.
(7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must
be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area
has been properly stabilized with a vegetative cover.
(8) Any proposed for grading within the 30' buffer from the Normal High Water must be contoured to prevent additional
stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in
a vegetated state.
(9) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction
completion.

boatlifts that are issued by the North Carolina Division of Coastal Management. If you have

ten (10) days of the receipt of this notice.
If you have no objections to the proposed work, please indicate on the enclosed forms, sign, date,
and include your telephone number. All proposed structures are to be located a minimum
distance of fifteen (15) feet from your area of riparian access, and as such, no waiver is being

Also enclosed with this letter is an Adjacent Riparian Property Owner Notification/Waiver Form.
This form is used in association with the general CAMA permits for excavation, bulkheads, and
boatlifts that are issued by the North Carolina Division of Coastal Management. If you have
objections or comments regarding the dredging, bulkhead, or boatlift, please write or call the
Division of Coastal Management at the address and telephone number shown on the form within
ten (10) days of the receipt of this notice.
If you have no objections to the proposed work, please indicate on the enclosed forms, sign, date,
and include your telephone number. All proposed structures are to be located a minimum
distance of fifteen (15) feet from your area of riparian access, and as such, no waiver is being
requested. Therefore the waiver section of the form is not applicable.
Please return the completed form to me in the enclosed self-addressed and stamped envelope.
Although the form explains that no response is considered the same as no objection, we would
appreciate your prompt reply, this allowing us to go forward with this project as soon as possible.

apply for CAMA permits to develop my property located at 503 Neptune Drive, Cape
