Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

for a Bulkhead Project at 126 North River Street, Currituck County
Dear Mrs. Toler:
This letter is in response to your objection as an adjacent riparian property owner to a permit
request from Jeffrey Shick for the bulkhead project at 126 North River Street, in the Peachtree
Beach subdivision of Currituck County. Mr. Frank Jennings, Field Representative for the
Division of Coastal Management staff, was recently on site to evaluate the permit applicant's
request.
The permit applicant has requested a permit to construct a bulkhead 100 feet long with two, 30-
foot return walls, and six-foot wide steps to the adjacent water body. Under the Coastal Area
Management Act (CAMA), the Coastal Resources Commission (CRC) has established Rules for
General Permits for this type of development that are found in 15A NCAC 07H A 100.
You have notified the Division of Coastal Management of your objections to this proposed
development by a letter dated April 11, 2006 that was received by our Morehead City office on
April 17, 2006 and by our Elizabeth City office on April 19, 2006. Your objections to this
proposed development related to the construction of a bulkhead and pier next door to your
property at 128 North River Street. You commented that a pier and bulkhead built on the
property at lots 22 and 23 North River Street would cause massive flooding on your property,
and also that your property would suffer massive flooding during a storm. Mr. Jennings has
reviewed your objections, along with all aspects of this development proposal for consistency
with the aforementioned Rules, which describe the CRC's standards and guidelines for this type
of development. Our review of the proposed development has found it to be consistent with these
Rules.
Mr. Shick's property has experienced shoreline erosion and loss of sand, which is evident by an
existing erosion escarpment and exposed tree stumps and roots. The property located 50 feet
north of Mr. Schick's property has a shoreline bulkhead. Mr. Shick has applied for a
CAMA/Dredge and Fill permit to construct a shoreline bulkhead to protect his property and
prevent further erosion. He has decided not to construct a pier at this time.

Flooding that may occur on your property usually can be attributed to high water in the
Albemarle Sound. It is difficult to envision how the presence of a bulkhead next door will cause
massive flooding on your property during a storm event any differently than if there were no
bulkhead on the adjacent property. The'lowest land will flood first. It is also difficult to
envision how the presence of a pier will cause massive flooding on your property as you have
indicated.
Therefore, after having given careful consideration to your objections to this proposed
development, we have determined that it is consistent with the Rules of the CRC and the State's
Coastal Management Program, and that all pre -requisites have been satisfied. Therefore, the
Division of Coastal Management issued General Permit No. 44615-A on May 1, 2006 (copy
attached) for a bulkhead and steps.
If you wish to appeal this permit decision, you must file a Third Party Hearing Request Form
with the Director of the Division of Coastal Management within 20 days of the permit issuance
date. If you choose to pursue an appeal, please contact this office so that we can provide you
with the appropriate forms and addresses.
