Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Subject: Application to build a mooring pier at 1009 Bracken Fern Dr. , Lot# 39 in Fairfield
Habour, Craven County.
Dear Mr. Hardeman,
Early February 2006, I received an "Adjacent Riparian Property Owner Notification/ Waiver
Form" from Foley & Foley Contractors to inform me, that my neighbor Mr. Porfiri plans to
construct a Boat Pier.
The application provides incorrect information pertaining the waterfront of lot # 39 and
therefore I am objecting this plan as shown.
After I purchased adjacent Lot# 38 in 1990, I know of at least four attempts been made to
acquire a Pier Permit. It looks like every new Owner is trying it again.
For Mr. Foley it is at least the third attempt. August 1994 he asked, for the then owner Bob
Carbon, and in March 2005 for the first time for Mr. Mike Porfiri.
In 1994, Mr. Foley provided a sketch with a waterfront length of 28 feet. His 2005 and 2006
applications are using a sketch with a waterfront length of 58.42 feet. This length needs to be
corrected to the projected line of the channel.
March 2005 Mr. S. Lang asked Mr. Foley to provide a survey with aerial photos to proof the
claimed waterfront length. I do not know if this was done.
Because waterfront can change but it does not grow, I am filing this complaint.
