Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistent with the North Carolina Coastal Management Program.

To Whom It May Concern:
I respectfully request a letter from the Ferry Division to the NC Wildlife Resources Commission
— Division of Engineering Services granting permission to use the Ferry Division's spoil sites at
Cedar Island Ferry Terminal and Fort Fisher Ferry Terminal. We request authorization to use this
site for a period not less than six months. The maintenance dredging out of boating access areas is
only expected to last three weeks; however, we will allow a de -watering period at our site prior to
transporting the material. Depending on the weather, we feel that we may need this extra window
of time. The spoil from each site is expected to be less than 1000 cubic yards of material.
NC Wildlife Resources Commission — Division of Engineering Services will assume
responsibility for all permits, clean up and/or damages caused by our use or crossing of the Ferry
Division property. Also, our use of the site will not interfere with operations at the Ferry
Terminals.

This letter is in response to your request for use of the Ferry Division dredge spoil sites at
Cedar Island Ferry Terminal and Fort Fisher Ferry Terminal. You are advised that your
request has been approved, subject to the conditions set for in your letter for a period of
not less than (6) six months. It is emphasized that the N.C. Wildlife Commission will be
liable for all clean up and/or damages associated with the use of the spoil sites. Further, it
is assumed that the Wildlife Resources Commission has obtained all applicable permits.

General Statute 113-229 requires that riparian landowners with property adjoining a proposed
excavation and/or fill project be given thirty (30) days in which to comment on the project. This form allows
the adjacent riparian landowner to express either:
