Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

between our lot and the lot owned by Mr. Alexander to our west. This plan does not directly
involve your property, but CAMA regulations require us to notify you and to receive a signed
letter indicating that you understand the plan.
Please find enclosed a scale drawing of Earl Davis Lots 43, 44, and 45 and a copy of our letter
to CAMA describing the project. Your signature below will confirm that you have received

Dear Mr. Hardeman:
Please find enclosed a scale drawing of Earl Davis Lots 43, 44, and 45. These are all located
on Bayview Dr. on Harkers Island. We are the owners of lot 44 (341 Bayview Drive) and with
the consent of our neighbor to the west (Mr. Peter Alexander), we are respectfully submitting
our plan for dredging the man-made canal between our property and lot 45. Also enclosed is a
signed letter of consent from Mr. Alexander.
As you requested, width measurements were made approximately every 100 feet on the canal.
These 12 measurements, indicated by dots on the diagram, gave an average width of 17 feet
and 7 inches. The water depths were measured on July 9, 2005 at approximately 11:30 pm.
This corresponds with a 24 inch high tide at the Harkers Island bridge. Tidal extremes for
2005 are predicted to be 2.26 feet (27 inches) and —0.61 feet (-7 inches) with a mean tide of
0.69 feet. (8 inches). The depths measured on this date were A) 81 inches for the receiving
waters, B) 27 inches at the mouth of the canal, C) 21 inches at the cut, and D)10 inches at the
dock end.
We would like a general permit to dredge approximately 1195 feet of the canal. The material
to be removed would be 36 inches in depth and 7'6" in width for a total of 996 cubic yards.
This material will either be redistributed on our lot, or hauled away.
We would also like a permit for a 5 foot wide, 230 foot dock over the marsh to allow us access
to the canal. Finally, we would like the dock permit to allow for a boat lift.
