Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistent with the North Carolina Coastal Management Program.

acknowledges work is being proposed to repair the canal bulkhead at the ad
property, 110 Teak Ct. The following statements and conditions have been
accepted by both property owners.
At the NW Corner of 112 Teak Ct. and the SW Corner if 110 Teak Ct., the
"star" cut into the concrete top of the bulkhead, identifying the corner
property location is to be maintained throughout the construction process and
after the work is completed. If eliminated, Keith D. Kelley shall obtain the
services of a licensed surveyor to have the property re -surveyed with proper
corner markers installed. All of these required services shall be paid by the
owner of 110 Teak Ct.
2. The present condition at the NW Corner of 112 Teak CA. shows no
requirement for re -construction work or repair as of Zoo.
This includes the vertical bulkhead panels, concrete toppirolong the top of
the bulkhead, the concrete tie -back supporting the bulkhead, nor is there is any
signs of soil sinking, washout or depression.
During the construction which includes digging, drilling, vibrating,
hammering or other means of construction utilized by the bulkhead contractor
or their sub -contractors, should any of these conditions change during the
construction period or 60 days after its completion, they are to be repaired
immediately to bring the bulkhead, soil and landscape features back to their
current conditions as found on the date of the accepting parties. All costs
associated with this work which includes time, labor and materials shall be the
responsibility of the 110 Teak Ct. property owner as well as any additional
work caused by delays in performing these repairs.
The owner of 112 Teak Ct. reserves the right to contract the repair work to the
112 Teak Ct. property to any qualified contractor 14 days from notification to
the 110 Teak Ct. property owner who shall be responsible for all associated
costs.

Dear Mr. Bailey: :YO�
I received your letter concerning the subject work on Wednesday August 15, 2006.
Three issues were addressed by you.
1. Blue Water will be doing the Bulkhead, Dredging and Repair Work.
2. Alan Bailey is Mrs. Doris Newton's Agent ( Mrs. Newton is the property
owner of 110 Teak Ct.)
3. I was given your phone number, the phone number for the Pine Knoll Shores
Building Inspector Chris Jones and the phone number for CAMA.
There is no mention of my concerns which will be attached and made a part of my
response to the Form — "Adjacent Riparian Property Owner Statement ". Per our
previous phone conversation you have no intention to formally accept this responsibility
for required work to repair any adjacent property damage.
I spoke with a contractor on the proposed work site who informed me he will be doing
the actual work but is not Blue Water. I was not given the sub -contractors name nor can
it be found on the equipment placed on site. Now I have another concern.
Per your letter and suggestion I have spoken to Linda Brickhouse of PKS Building
Inspector Office who will be responsible for the issuance of a building permit, and Mr.
Stephen Lane who is with CAMA and has jurisdiction of this area.
From these efforts, my recognition that the work will be done will also contain my
concern's identified as Attachment One. As such I think the best way for all of us to be
satisfied, both you and I should be present at the site when this work is performed.
Both of us will know if we have a problem where Attachment One is applicable and
necessary for your response. If this meets with your satisfaction please give me as much
notice as possible so I can arrange my schedule to be on site. Hopefully we will not have
any problem, but from previous experiences I see the need for this protection.
