This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The situation in the case of the subject permit application (Innerbanks Construction - on behalf of ODOM) to install a boat lift at the community dock at 125 Spinnaker Lane, Havelock, is as follows: The community dock is owned by the Moorings Dock Owners association. As a member of the Association, Mr. Odom has a deeded right to a slip on the dock. The Moorings Dock Owners Association has narrow easement, from the street to the water line, across my property for members to access the Dock. My wife and I own the property on both sides of the easement. The Moorings Dock Owners Association has voted to allow boat lifts, provided that there is no physical attachment to the dock other than an electrical connection from the slip electrical service point to the Lift. The permit requested is in effect a request to build a structure in the water without ownership of any adjacent waterfront property. Under these circumstances, the structure is not within the riparian area of the the person(s) requesting the permit. There are 22 slips at the Dock. If a single permit is issued, it will be tantamount to permitting 22 boat lifts in a concentrated small cove on the creek, adjacent to a small designated 404 wetlands area. You are undoubtedly aware that Clubfoot Creed is already under considerable environmental stress due to substantial development both in the water an along the adjacent shoreline. Protection of the natural conditions of the Creek is a primary concern of mine which is the reason I believe the that permit should not be issued. Every little bit of protection helps however small it might be. If additional information or documentation is helpful as you consider the subject permit application, I am most willing to accommodate to the extent that it is helpful to you. you can call me at 252-444-3079 Thank you for your consideration and attention to this matter. Havelock, NC 28534 Emile, they are correct in that they do not need permission from you, only to notify you so that if you have objections you can disclose them to us, and we can consider them in making the permit decision. I suggest that you put your specific objections to the proposal on paper and send to Stephen Lane, who is also cc:'d on this mail. He will be handling the permit. If a permit is issued, there is a third party appeal process that you can undertake, and with your written objection, I can send you the information you will need should you choose to go that route. My reason for writing to you is to clarify the rules re the intent of Innerbanks Marine, and if they are correct, to discover if there is an appeal process to challenge the issue of a CAMA permit.
