Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. You are permitted to move the two pilings between slips E2 and E4 two feet north thus widening E2 to 17 feet and narrowing E4 to 13 feet. You will be responsible for arranging all permits, selecting and managing the contractor, paying all costs and completing the project to the satisfaction of the Association. 2. You may enjoy the use of slip E2 as long you need it for CYGNUS or other wide vessels owned by you and you continue your membership in the Association. At such time that you no longer own a wide vessel needing such a slip or are no longer a member of the Association, the Association will require you to return the two pilings to their original positions. You must complete restoration within 30 days of receiving notification in writing from the Association 3. Prior to moving pilings you must set up an interest bearing escrow account at a mutually agreed institution to insure funding for the return of slips E2 and E4 to original condition after the wide slip is no longer needed. You will provide escrow money equal to the bid price for the project plus 25% plus the cost of two replacement pilings (in case old pilings are broken when reset in original position). Any unspent money, including accumulated interest, after returning the pilings to original position will be returned to you If the escrow money, including accumulated interest, is insufficient to pay the full cost you will be required to pay the difference. These slips are located at the end of the dock and are the two to the south. The sketch attached depicts the proposed change.
