Any violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian landowner(s) . The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available information and belief, certify that this project is consistent with the North Carolina Coastal Management Program. Ross Jr., Secretary June 27, 2002 This letter is in reference to your correspondence received by facsimile on June 24, 2002, objecting, as an adjacent riparian property owner, to a request from Mr. Charles M. Pereira, to construct a pier at the end of a Rocky Rollinson Road, adjacent to the Pamlico Sound, in Dare County. Mr. Dennis Hawthorn of the Division of Coastal Management staff was recently on site and has reviewed Mr. Pereira's proposal. Mr. Hawthorn reviewed the request to construct a 24-foot long by 6-foot wide pier along this shoreline. According to information supplied by Mr. Pereira's contractor, this proposed pier structure also includes a 20-foot by 6-foot "T" platform at the waterward end of this pier. During Mr. Hawthorn's site visit and review of this proposal, measurements were taken concerning the proposed pier alignment, and its relationship to both adjacent riparian setback areas, and the existing navigation constraints. Mr. Hawthorn's findings clearly indicated that the structure as, proposed, will be well within the applicant's riparian waters, and will not infringe upon any adjacent riparian access or navigation. These findings indicate that the proposed pier structure is consistent with T15A. Section 07H.1200 General Permit for Construction of Piers: Docks: and Boat Houses in Estuarine and Public Trust Waters, of the North Carolina Administrative Code, The Division has also reviewed the concerns noted in your June 24, 2002 correspondence, and has determined the following: 1) The existing water depths in the vicinity of the proposed pier are all approximately 2 feet below the normal water level (NWL). The referenced navigation channel, to the east of Mr. Pereira's property, is also 2 feet in depth. The proposed pier will extend approximately 30-feet beyond the shoreline of Mr. Pereira's property. Mr. Hawthorn actually observed navigational use of these waters during his visit, and found no evidence that indicated that the proposed pier would infringe upon any navigation or adjacent riparian access. 2) Mr. Pereira's lot is approximately 123 feet wide along the shoreline. This dimensional area is consistent with our rules regarding the allowable size of platform area. The proposed pier "T" platform will be approximately 45 feet northwest of Mr. Willis' riparian line, or 30 feet northwest of Mr. Willis' riparian setback. This platform will be approximately 60 feet southeast of your riparian line, or 45 feet southeast of the riparian setback. These findings indicate that the proposed pier structure will be well outside of the riparian setback areas for both adjacent riparian property owners. 3) According to Mr. Pereira, as of June 27, 2002, Mr. Willis is still the adjacent riparian property owner to the east. If this property should be sold prior to the commencement of construction on this pier, the permittee is required to notify the new adjacent property owner only if some portion of the pier will encroach into the new property owner's adjacent riparian setback area, and an adjacent riparian property owner waiver statement will be required. The proposed pier will not encroach into either neighboring setback area, and as proposed, will not require a waiver statement from either adjacent riparian neighbor. The Division of Coastal Management has given your objections careful consideration and has found that the project is consistent with the appropriate rules and regulations of the Coastal Resources Commission. Therefore, the Division issued CAMA General Permit 30279A (copy enclosed) on June 26, 2002 to Mr. Pereira. If you wish to appeal this decision, you may file a request with the Director of the Division of Coastal Management, Department of Environment and Natural Resources within twenty (20) days of the permit decision.
