This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that l) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

RE: Objections to the Issuance of General Permit to Install a Pier and Boatlift in Dare County
Dear Mrs. Maish:
This letter is in reference to your correspondence received on February 15, 2002, objecting as an adjacent
riparian property owner to a request from Gerald and Pamela Palm to construct a pier and boatlift within your
riparian corridor. Lynn Mathis of the Division of Coastal Management staff was recently on site and reviewed the
proposal, and noted that the pier and boatlift could not encroach into you riparian corridor without written consent.
Ms. Mathis reviewed the request and the owners, Gerald and Pamela Palm, and they agreed to reduce the size of the
pier to accommodate your concerns. The structure will be placed in compliance with the 15' riparian corridor. The
modified request has been found to be consistent with T15A, Section 07H .1200: General Permit for Construction of
Piers: Docks: and Boathouses in Estuarine and Public Trust Waters, of the North Carolina Administrative Code.
The Division of Coastal Management has given your objections careful consideration and has determined
that the project, as modified, is consistent with the appropriate rules and regulations and that all prerequisite
requirements have been met. The Division issued General Permit #30005A on February 19, 2002, to Gerald and
Pamela Palm (See Enclosed Permit). I can assure you that the placement of the structures will be in compliance
with the Division's standards or will be removed.
If you wish to appeal this decision, you may file a request with the Director of the Division of Coastal
Management, Department of Environment and Natural Resources within twenty (20) days of the permit decision. If
you have any questions regarding this matter please do not hesitate to contact me in the Elizabeth City District

Having received the February 07, 2002 correspondence on the request for a change to the
minimum set back distance of fifteen (15') we must object to the proposed project for the
following reasons:
1. As per the enclosed diagram we feel that the proposed dock with the changed
setback would interfere with our present dock and slip.
2. We feel that giving permission to change the current setback would interfere with
the ability to sell our lot in the future should we choose to.
3. With the average size of lots of 40 feet we feel that the size of the proposed dock
is oversized for the lot and would impinge on our ability to increase our dock size.
