The bags will be placed approximately two feet below grade and will not impede access to your property. Lynn Mathis of the Division of Coastal Management staff was recently on site and reviewed the NCDOT proposal, and noted that the section of Virginia Dare Trail, where sandbags are being proposed, qualifies as an imminently threatened structure to undertake temporary protective measures. Ms. Mathis reviewed the request for sandbags and found it consistent with T15A, Section 07H .1700: General Permit for Emergency Work Requiring a CAMA and/or Dredge and Fill Permit, of the North Carolina Administrative Code. The Division of Coastal Management has given your objections regarding the erosion control structure careful consideration and has determined that the project, as proposed, is consistent with the appropriate rules and regulations and that all prerequisite requirements have been met. The Division issued General Permit #31231A on January 7, 2002, the North Carolina Department of Transportation (See Enclosed Permit). I. can assure you that the placement of the sandbags will be in compliance with the Division's standards or will be removed. If you wish to appeal this decision, you may file a request with the Director of the Division of Coastal Management, Department of Environment and Natural Resources within twenty (20) days of the permit decision.
