Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowner(s) .
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythatthis project is consistentwith the North Carolina Coastal Management Program.

Dear Mr. & Mrs. Wingate:
This letter is in reference to your correspondence received on November 19, 2001, objecting as an
adjacent riparian property owner to a request from the North Carolina Department of Transportation
(NCDOT) to place sand bags along the east side of Virginia Dare Trail within the right-of-way. The bags
will be placed approximately two feet below grade and will not impede access to your property. Lynn
Mathis of the Division of Coastal Management staff was recently on site and reviewed the NCDOT
proposal, and noted that the section of Virginia Dare Trail, where sandbags are being proposed, qualifies as
an imminently threatened structure to undertake temporary protective measures. Ms. Mathis reviewed the
request for sandbags and found it consistent with T15A, Section 07H .1700: General Permit for Emergency
Work Requiring a CAMA and/or Dredge and Fill Permit, of the North Carolina Administrative Code.
The Division of Coastal Management has given your objections regarding the erosion control
structure careful consideration and has determined that the project, as proposed, is consistent with the
appropriate rules and regulations and that all prerequisite requirements have been met. The Division issued
General Permit #31231A on January 7, 2002, the North Carolina Department of Transportation (See
Enclosed Permit). I. can assure you that the placement of the sandbags will be in compliance with the
Division's standards or will be removed.
If you wish to appeal this decision, you may file a request with the Director of the Division of
