Statement of Compliance and Consistency
This permit is subject to compliance with this application, site drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine or criminal or civil action; and may cause the permit to become
null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The
applicant certifies by signing this permit that 1) prior to undertaking any activities authorized by this permit, the applicant will
confer with appropriate local authorities to confirm that this project is consistent with the local land use plan and all local
ordinances, and 2) a written statement or certified mail return receipt has been obtained from the adjacent riparian
landowners).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certifythat this project is consistentwith the North Carolina Coastal Management Program.

ADJACENT RIPARIAN LANDOWNERS STATEMENT
General Statute 113-229 requires that riparian landowners with property adjoining a proposed
excavation and/or fill project be given thirty (30) days in which to comment on the project. This form allows
the adjacent riparian landowner to express either:
1) objection to the project
2) no objection to the project and the desire to waive the right to the 30-day period so that application
processing can progress more rapidly. The adjacent riparian landowner may also choose to not
sign the form at all.

SPOIL AREA USE AGREEMENT

I. AUTHORITY
This AGREEMENT is made and entered into by and between the North Carolina
Wildlife Resources Commission, hereinafter called the COMMISSION, and the North
Carolina Department of Transportation, hereinafter called the DEPARTMENT.
II. INTRODUCTION
WHEREAS, the COMMISSION plans to perform maintenance dredging at the
COMMISSION operated boating access area located at the terminus of N.C. Highway 12
in Cedar Island, Carteret County and WHEREAS the DEPARTMENT controls the said
property, NOW, THEREFORE, the parties hereto agree as follows:
III. TERMS
A. THE COMMISSION HEREBY AGREES TO:
1. Acquire all necessary permits to prior to commencing dredging activities.
B. THE DEPARTMENT HEREBY AGREES TO:
1. Allow encroachment upon the spoil area for the purpose of disposing spoil
resulting from the proposed maintenance dredging.
