This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and limitations as specified therein. Division approval is based on acceptance of the certification provided by a North Carolina -licensed Professional Engineer in the application. Failure to comply may result in penalties in accordance with North Carolina General Statute § 143-215.6A through § 143-215.6C, construction of additional or replacement wastewater collection facilities, and/or referral of the North Carolina -licensed Professional Engineer to the licensing board. This permit shall become voidable unless the wastewater collection facilities are constructed in accordance with the conditions of this permit; 15A NCAC 2H .0200; the Division of Water Quality's (Division) Gravity Sewer Minimum Design Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design Criteria for the Fast -Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable; and other supporting materials unless specifically mentioned herein. 2. This permit shall be effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The wastewater collection facilities shall be properly maintained and operated at all times. The Permittee shall maintain compliance with an individual system -wide collection system permit for the operation and maintenance of these facilities as required by 15A NCAC 2H .0227. If an individual permit is not required, the following performance criteria shall be met as provided in 15A NCAC 2H.0227: a. The sewer system shall be effectively maintained and operated at all times to prevent discharge to land or surface waters, and any contravention of the groundwater standards in 15A NCAC 2L .0200 or the surface water standards in 15A NCAC 2B .0200. b. A map of the sewer system shall be developed prior to January 1, 2004 and shall be actively maintained. C. An operation and maintenance plan shall be developed and implemented. d. Pump stations that are not connected to a telemetry system shall be inspected at least three times per week until July 1, 2000; thereafter, pump stations shall be inspected at least daily, as defined in 15A NCAC 2B .0503(5), until July 1, 2001; and thereafter, pump stations shall be inspected every day. Pump stations that are connected to a telemetry system shall be inspected at least once per week. e. High-priority sewer lines shall be inspected at least once per every six-month period of time. f. A general observation of the entire sewer system shall be conducted at least once per year. g. Inspection and maintenance records shall be maintained for a period of at least three years. h. Overflows and bypasses shall be reported to the appropriate Division regional office in accordance with 15A NCAC 2B .0506(a), and public notice shall be provided as required by North Carolina General Statute §143-215.1C. _ 4. This permit shall not be transferable. In the event there is a desire for the wastewater collection facilities to change ownership, or there is a name change of the Permittee, a formal permit request shall be submitted to the Division accompanied by documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request shall be considered on its merits and may or may not be approved. 1 DEC 0 7 2001 5. Construction of the gravity sewers, pump station(s), and force mains shall be sched service by the existing utilities nor result in an overflow or bypass discharge of waters of the State. 6. Upon completion of construction and prior to operation of these permitted facilities, a certification, a copy of the construction record drawings, as well as supporting design calculations for any pump stations permitted as part of this project shall be received from a North Carolina -licensed Professional Engineer certifying that the facilities have been installed in accordance with this permit; 15A NCAC 2H .0200; the Division's Gravity Sewer Design Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design Criteria for the Fast -Track Permitting of Pump Station and Force Main adopted June 1, 2000 as applicable; and other supporting materials. If this project is to be completed in phases and partially certified, you shall retain the responsibility to track further construction approved under the same permit, and shall provide a final certificate of completion once the entire project has been completed. A copy of the construction record drawings, indicating the facilities constructed in the phase being certified, shall be submitted with each partial certification. Mail the Engineer's Certification, one copy of the "Construction Record Drawings", and one copy of the supporting design calculations to the Non -Discharge Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699-1617. A copy of the construction record drawings shall be maintained on file by the Permittee for the life of the wastewater collection facilities. Failure to abide by the conditions and limitations contained in this permit; 15A NCAC 2H .0200; the Division's Gravity Sewer Design Criteria adopted February 12, 1996 as applicable; the Division's Minimum Design Criteria for the Fast -Track Permitting of Pump Station and Force Mains adopted June 1, 2000 as applicable; and other supporting materials may subject the Permittee to an enforcement action by the Division, in accordance with North Carolina General Statutes § 143-215.6A through § 143-215.6C. 9. In the event that the wastewater collection facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement facilities. 10. The issuance of this permit shall not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances that may be imposed by other government agencies (local, state and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A NCAC 2B .0200, erosion and sedimentation control requirements in 15A NCAC Ch. 4 and under the Division's General Permit NCG0100000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 15A NCAC 2H .0500. 11. Noncompliance Notification: The Permittee shall report by telephone to the Wilmington Regional Office, telephone number (910) 395- 3900, as soon as possible, but in no case more than 24 hours or on the next working day, following the occurrence or first knowledge of the occurrence of either of the following: Any process unit failure, due to known or unknown reasons, that renders the facility incapable of adequate wastewater transport, such as mechanical or electrical failures of pumps, line blockage or breakage, etc.; or b. Any failure of a pumping station or sewer line resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. Persons reporting such occurrences by telephone shall also file a written report in letter form within five days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. RECEIVED * t- O/Ukm' SEO71C fd r tics, -0! -hzr;ge Farmi-,;;T The Division is highly concened about possible impacts to a rare species of butterfly – an undescribcd species of dusted sldpper (Aoronopsis n, sp.1) – resulting from development ofRadio Island. We have previously discussed these concerns in reviews of the ELS for the Port Expansion Project (Hall, 1119100: HaJIL 5/251611), which are attached. This ourerly is lmoamm to o cur only along a mstiicted section of the North Carolina coast. Populations art currently L-ncwII only from Radio jsland, Brandt Island, Bogue Banks, and Boar island. Given ftie int-_nse development that has occurred over most of Bo¢ue Banks and the impe.-Lding development of Radio Island, this species appears to be at great risk of extinction. The US Fish and Wildlife ScrvZce, consequently, has identified it as a federal Species of Concern. Once the species is formally named, it will then be eligible for federal listing as an Endangered or Threatened Species. In preparation forpossible listing, the Service contracted the NC Natural Heritage Program to initiate a status survey for this butterfly. The results of field work conducted in July and August of this year uphold previous data on its distnbittioa: the butterfly was found at two new sites on Bogue Banks but not at sites to the north or south of its current range limits. Suitable habitat may, in fact, not exist south of Pendcr County, but even large tracts of apparently suitable habitat at Cape Lookout in Carteret County and at several sites in Onslow and Pender Counties were found to be unoccupied. J Ricl:,Sbiver, Water Quality Supeenrisor Page 2 November 7, 2001 The proposed extension of sewer service to Radio Island is likely to have both direct, indirect, and cumulative impacts on the butterfly and its habitat. Direct impacts are likely to result from the laying in of the sewer line within the right -of way along Mute Drive. The strip of grassy habitat that cuzrently exists along both side of this road supports the grass, Schtzachyrium littorale, fed upon by the larvae of the butterfly and adults ofAtrytonopsu n. sp. 1 have been frequently observed along this strip. These direct impacts are likely to be relatively insignificant, as long as a much, greater area of habitat still exists over the rest of Radio Island, They are also likely to be tmznpozary in nature, if the natural vegetation is allowed to regrow along the disturbed right-of-way. An effort to replant Schizachyrium Utrorale directly would greatly speed up the process. Ofmuch greater concern are the likely indirect and cumulative impacts resulting frm the extension of sewer service to Medio Island. It is our understanding tbat in addition to allowing the construction of 80 new dwelling units at the Olde Towne Yacht Club, this sewer line will ultimately sez•ve all the devclopmentpmj ects planned .for the island, including the port expamion and, potentially, the liquid natural gas storage facility, if it is approved. As mentioned in our comments op the EIS for the port expansion project, each of these proposed projects would drastically decrease the amount of habitat available to the butterfly on the island — the port expansion project alone will result in the paving of 68.7 acres of habitat currently supporting the butterfly. Cumulatively, these projects may elimi ate the butterfly from Radio Island altogether. Given that Radio Island renresents one of me larges blocks of occupied habitat anywhere within the ranee of this species, loss of this population unit threatens the viability of the species overall.. Based on our understanding that extension of water and sewer to Radio Island is ultimately intended to faaili to ail development on the island, we believe that the cuircnt project accounts for only a Small portion of the ovcza.11 impacts that can be expected- Ordinarily, we request that evaluation of a project's impacts mot be segmented Into smaller units, obscuring the overall significance of the effects on the environment. We are also concctned about looking at only one phase of a project at a time, since that can lead to construction designs in the initial phase that lock in a constricted set of altemzdves for the later phases. While our preference would be for an EA to be prepared, we understand that this project, in its currently limited state, falls below the minimum criteria set by the Division of Water Quality needed to raise the level of assessment to an EA Since we have alzleady had an opportunity to comment on the port expansion project, we are willing to wait for another opportunity to comment on the potential er=crs to the butterfly of the build -out of Radio Island. We note, however, that the Port Authority has agreed to consult with, both the US Fish and Wildlife Service and the Natural Heritage NOV. 2.2201 4:21PM NCDENP. So far, no such consultation has taken place. Until the issues regarding mitigation of the impacts of the Radio Island development projects have been resolved, we will continue to look for opportunities to bring them up for discussion. For that reason, we request to be included in the review of either an Special. Mom importantly, the presence of a rare butteri7y. Attytvn0Ps1.s new species, hu been rer;ognized (Table 3.11; p- 3-32) and the possibility of the project's impacts to this species has been identified (p. 414). However, the current document only makes brief mention of this spxies, despite the fact that it appears to have the highest level Of conservation wnceM of any species likely to be affected by this prof ect. Nor is there any discussion of mitigation measures that might help offset the impacts to this species. This butterfly is designated as a Species of Concern by the US Fish and Widlife Service and available evidence suggests that it may actually be critically imperilled, i.e., in threat of outright extinction rather than, just local ext4pation. We therefore regard the failure to fully discuss the significance of this species, the magnitude of Maly impacts (including direct, secondary, and cumulative), and the feasibility of possible mitigative measures as major flaws in this document We ask that these deficiencies be rectified before the EIS is approved. Although much of the available information on this butterfly is summarized in an attachment to our previous comments (see Appendix A), new information was obtained on a site visit to the project site in April, 2001. This visit was done with permission of the Port Authority and was attended by representatives of the Port Authority, US Fish and Wildlife Scryic-,and NC Division of Parks aztd Recreation. The question as to whether the butterfly is present on project site was answered definitively: over 50 individuals were observed on the fort Authority property, including both malts and females. Furthermore, individuals were observed over vktually the entire extent ofthepropwty, from the boundary with the Naval facility on the south to the fence line separating the property from the fuel depot on the west and the marina on the north, The larval host plant of the butterfly — seaside little bluest= — was likewise present over the entire ares, NOV. 8.2001 4:?3PN NCDENP WIRD N0. 138 P.5 Melba McGec Page 5 June 25, 2001 D�G 07200, In comparing the habitat at Radio Island to Brandt Island and Fort Macon, which we visited on the same day, Radio Island appeared to have the greatest amount, roughly 100 acres in extent (determined using ArcView froze. orthophotoquads). The butterfly and its host plant se=od to be confined to a much smaller area on Brandt Island, oe gpriivarily along a nazi w ,strip ofhabitat on the cast side of the island; the entre arca occupied by the dredge spoil storage basin seemed completely unsuitable. According to Randy Newman, Park Raagcr at Fort Macon State Park, the two areas occupied by the butterfly on Brandt Island cover roughly 14 acres and 30 acres respectively, Ranger Newman estimates that about 73 acrrs of habitat is present at Fort Macon, located mainly behind the dunes bordesiug the beach. Butterfly populations in all darer primary areas appeared to be vigorous, with possibly the greatest density observed at Fort Macon. Although separated by water to varying degrees, all three populations probably exchaage individuals and the presence of a m.etapopulation may be a critical factor in the survival of this species in an essentially disturbance -prone and disturbance -maintained environment (see summary in Appendix A). While the Radio Island population currently appears to be a critical element in `dais metapopulation, there is some possibility that additional population units occur on adjoining islands. This will be izxvestigated this sinner by staff of the NC Natural Heritage Program wonting under a US Fish and Wildlife Service contract. Other likely habitats in North Carolina will also be sampled and specimens Coll=tcd dtuing this study will be used to help resolve some of the taxonounie questions mentioned in our earlier s1,mma-y of the biology of this butterfly. The results of this survey, along with on-going taxonomic work being done by John Burns at the US National Museum, will be evaluated by the US Fish and wildlife Service in order to determine the urgency of Federal protection measures. In response to our earlier comments on this project, tine current draft states that the PoTt Authority will `�z go consultation with the US Fish and Wildlife Service (USFWS) to determine the effects of the project on the species", but apparently only if the species 'becomes a listed species and is determined to occur on the island" (p. 7-5). As noted above, the species is now known definitely to occur within the project site, resolving one of these issues. However, the delay in taking protective action until the species is foimaIly placed on the US Endangered Species List — if that happens -- may have severe impacts on the butterfly, if one of its most importzat habitat arr. s is scraped clean and paved in the meantime, Rather than wait for a lasting decision for protection measures to be discussed, we strongly recommend that the Port Authority begin, consultation with USFWS now. *Vile particularly urge that the mitigative measures we suggested in our earher'review be given f X11 consideration. Either designation would make it eligible for federal listing as Threatened or Endangered, which appears tQ be warranted on the basis of its extremely limited distribution and on the number of threats it faces (see attachment). Currently, the DEIS does not contain any information on this butterfly, which we concede is likely due to the recency of the announcement that it represents a new taxon. We also acknowledge that the letter from the Natal Hexit4gc Program (Giles, 10/28/97) did not mention this species, and that the butterrly was added to our database only this last year. Although this species doc,5 not yet have any legal protection, and studies are needed to clarity its taxonomic status, distribution, and conservation concerns, we strongly recommend that the EIS be revised m discuss the potential impacts to this species arising from the project. This discussion should include cumulative and secondary impacts as well as the direct impacts of the proj ect This is important since at Icast two otherprojects are planned for sites oa Radio Island gnat appear to have habitat suitable for this butterfly. Since actions taken now may drastically affect the chances of this species' survival, we strongly urge the applicant to work with the US Fish and Wildlife Service to develop a conscr%atioA plan for this butterfly before any listing decisions ale made. Successful implementation of a conservation, plan may, in fact, head off the need to list the species and thereby reduce the amount of future regulatory burden for projects in this viciniy. .' As camponent s of this plan, we would like to see at least some habitat areas at both the south and north ends of Radio Island be protected from development, Habitat management on Brandt Island, which is also owned by the ports Authority, should also be considered in this pian, NOV. 3. 2001 4:25PM NCDENR WIPO NO. 152 P.3 Melba McCree Page 7 November 9, 2000 SUKMARY OF WHAT IS CURRENTLY 1QtpWI` ABOUT AT,EXTONO. = rS Description of the Species In July, 2000, John Bungs (US National IvMusei=) presented a paper at the annual meeting of the Lepidopterists' Society describing the differences betweenthis butterfly (Atrytonopsisnew species) and the dusted skipper (Atrytonopsis hianna), populations of which occur over much of eastern North America, The new species was fbirad to differ from the dusted skipper in both adult and immature morphological features; inits restriction to barrier island habitats, whichthe dusted skipper is not known to occupy anywhere within its range; and in its larval host plant, seaside little bluestem (3chizachyrium littorale), which the dusted skipper is not known to usc. According to Dr. Burns, this new butterfly appears to be restricted to the central North Carolina coast, and is currently known only froxm Fort Macon Statc Paris, Brandt Island, and Radio Island at the north end of Bogue Banks, and from Bear Island (Hammock's Beach State Park) located immediately south of Bogue B enks, Efforts to find the species on Shackelford Banks and Brown's Island, to the north and south of the currently known range respectively, have so far had negative .results. A full status survey to deterniitie the range more exactly has been proposed to the US Fish and Wildlife Service by the Natural Heritage Program. Dr. Burns intends to publish his findings within the next year (J. Borns, pets. comm.), which will include giving the species a formal name aAd giving features.. a full description of its distinguishing We hope that this paper will also resolve some remaining questions concerning the relationship of the Radio Island butterfly to the southern dusted skipper (4riyConopsis loammz) and the -relationship between the southern dusted skipper and the dusted slipper. An altcanate hypothesis concerning fide taxonomic position of the Radio Island butterfly is that it is more closely related to the southern dusted slipper, and is possibly a subspecies of it. Even in that case, however, it would still be eligible for federal listing, particularly since the southern dusted skipper itself is now Isnown from less than. 10 populations, one in North Qarolina (in addition to the Bogtu Banks form) and the rest in Florida. The Natural Heritage Proms has also proposed conducting a survey to determine whether this species merits federal listing, Importance of Radio Inland to the Swnival of the At"nopsis n. op. Radio Island supports one of three populations of the butte-fy located at the east end of Bogue Bank (an isolated coloxty also occurs on Bear Island). A site visit to Radio Island was made on Oct. 17; 2400. As a part of the application process, the Town is required to notify adjacent riparian property owners of the proposed work. Property owners desiring to comment on the proposed work must do so in writing within ten (10) days of receipt of this notice. No response will be interpreted as no objection. Coastal Management staff will review all comments and determine if the proposed project can be approved by a General Permit.
