Slack, for his property at the intersection of SR 1350 and SR 1332 at Northern Pond on Ocracoke in Hyde County. I fiirtber enclose the $2..50.00 filing fee, 8 1/2 x 11 inch work drawings, a letter from Mr. Slack authorizing me to act as his agent, and a copy of Mr. Stack's deed to the property. I also enclose copies of the notices forwarded > certified mail to the adjoining riparian landowners and the return receipt green car for your file. Please note that one adjoining property owner has no objection to the permit pursuant to the attached letter off no objection- 1/23/95 was the last date for Mr. Jack Vilson or Mrs_ Ruth Wilson to object. Please provide me a copy of their objection, or please state that you have received no objection. YOU HAVE ISSUED A PERMIT TO MR. JACK WILSON (THROUGH HIS WIFE'S NAME RUTH J. WILSON) AND HE IS CURRENTLY BUILDING A DOCK ON MY CLIENT'S LAND. You were extremely well aware of the boundary problem concerning the Wilson permit, which was reinforced by the attached permit application. The attached CAMA permit application was filed as a direct objection to Wilson's permit application and served on our office on December 27, 1994 as you will note from the attached green return receipt 1'I' COVERS THE SAME BOUNDARY AREA CLAIMED BY MR. I specifically pointed this out to Mr. Schaffer in your office where he returned the major CAMA permit application for additional information_ You have failed and refused to follow your own procedures in issuing the Wilson's wrongfully approved permit. You leave me no choice but to seek appropriate action before the Office of Coastal Management. Wilson's property off SR 1350, adjacent Nortbern Fond (Pamlico Sound), on Ocracoke Island in Hyde County, North Carolina. This letter also ref'emnces the second waiver received by you on 21 December 1994 to which you did not respond as of 20 January 1995. Although you objected to an earlier pie; proposal by Mrs. Wilson, I rmeived no coxmnent refer,eme the "lodirled proposal for a 61 by 75' pies that was oriented in accordam-C With a new survey and addressed in the ten day waiver Ietter you received on 21 De Amber 1994. I have discussed the project with Mr. Jeff Schaffer, Field Representative for the Division of Coastal Management, and with Mrs. Robin Smith, North Carolina Attorney [General's Office, and conclude that the proposed pier is within Mrs. Wilson's corridor of riparian access. Therefore, I recommewled a permit be issued for the consuvetion (see attached). If you wish to challenge my granting of the permit you may file a thitd party hearing request with the Chairman of the Coastal Resources Commission as provided in GS 113A-121.1 (b) within 20 days of the permit decision- I do share your concerns but I consider Mrs. Wilson's request to be reasow*le; within her riparian area, and consistent with the guidelines for development in subcbaptet 711. of the North Carolina Administrative Code. Wilson's property off SR 1350, adjacent Northern Pond (Pamlico Sound), on Ocracoke Island in Hyde County, North Carolina. This letter also references the second waiver received by you on 21 December 1994 to which you did not respond as of 20 January 1995. Although you objected to an earlier pier proposal by Mrs. Wilson, I received no comment reference the modified proposal for a 6' by 75' pier that was oriented in accordance with a new survey and addressed in the ten day waiver letter you received on 21 December 1994. I have discussed the project with Mr. Jeff Schaffer, Field Representative for the Division of Coastal Management, and with Mrs. Robin Smith, North Carolina Attorney General's Office, and conclude that the proposed pier is within Mrs. Wilson's corridor of riparian access. Therefore, I recommended a permit be issued for the construction (see attached). If you wish to challenge my granting of the permit you may file a third party hearing request with the Chairman of the Coastal Resources Commission as provided in GS 113A-121.1 (b) within 20 days of the permit decision. I do share your concerns but I consider Mrs. Wilson's request to be reasonable, within her riparian area, and consistent with the guidelines for development in subchapter 7H. of the North Carolina Administrative Code.
