This permit is subject to compliance with this application, site
drawing and attached general and specific conditions. Any
violation of these terms may subject the permittee to a fine,
imprisonment or civil action; and may cause the permit to be-
come null and void.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
The applicant certifies by signing this permit that 1) this pro-
ject is consistent with the local land use plan and all local
ordinances, and 2) a written statement has been obtained from
adjacent riparian landowners certifying that they have no
objections to the proposed work.

Beach Nourishment North of Buxton,
Project 4.5050009
As you requested a review of subject location has been made
and the following comments are offered.
The beach nourishment project for protection of NC 12
authorized under LAMA Permit Number 12805 was initiated in
mid December, 1993. Due to storm activity and extreme
weather conditions extensions of permitted completion dates
were obtained and the work terminated in mid March, 1994.
You reported that in June, 1994 CAMA office in Morehead City
requested information relative to beach profiles which may
indicate volume of material placed on the beach.
At subject location the distance between the highway and
mean high tide exceeded the 300' threshold for warrant in
protective action. As the distance was about 2001, the
proposal and plan was expedited to provide immediate
protection for the highway with respect to the forth coming
storm season.
Due to expeditious handling of the proposal, no base data
relevant to existing beach profile was obtained prior to
placement of material on the beach. On July 27, 1994 this
office collected data at the site in order to provide a best
estimate of material placed. Representative profiles were
obtained at undisturbed areas north and south of the project
limits. Likewise, profiles were obtained within the project
limits.

Calculated volume of material was determined from the data
collected on July 27. Adjustment was made for reshaping of
the material by natural forces using Corps of Engineers
factor of 50% distribution below Mean Low Tide. Placement
of material by hydraulic dredge results in some loss of
material from the upper beach and was estimated by dredge
operators to be about 20%. The estimated volume on the
beach with adjustment accounts for about 100,000 c.y. of
material. However, information provided by Ferry Division
records of the work identify between 190,000 and 195,000
c.y. of material.
Ferry Division personnel advised that storm activity during
the dredge operation significantly reduced material on the
beach during several occasions. Therefore, absence of base
data, lapsed time after project completion, and storm
activity during the project have contributed to inability to
provide accurate accounting of material placement.

Reference is made to your April 21st memo concerning a joint
follow-up inspection of the dredging undertaken near Buxton for
beach renourishment. By copy of this I am asking Doug Huggett to
contact you to set a time for the field review. Doug will
coordinate with our Division Office and the Ferry Division. Let
us know if you want him to contact National Marine Fisheries.
Doug will be on vacation the first week of May; therefore, it may
be a week or so before you hear from him.

I have been advised by our staff in the Elizabeth City office that
the dredging for beach nourishment at Buxton, which was approved
with a CAMA emergency general permit, has been completed. I am
interested in a joint follow-up inspection to verify that the
dredging was done within the proscribed boundaries, and, to
determine if there are any obvious immediate impacts to the
adjacent sea grass beds. I am also interested in an analysis of
how the dredged material has been distributed on the beach and what
benefits have occurred as a result of the nourishment.
Your staffs' participation in the inspection is important since
they have the pre -project beach profiles and the GPS information on
the boundaries of the borrow areas. Please let me know who on
your staff this can be coordinated with and their availability so
that we can plan the visit. I think that it will be helpful to ask
the National Marine Fisheries Service to also participate.
