Dear Mr. Davis:
This correspondence is in reference to your letter of objection to a proposed pier project by
your adjacent riparian property owner, Mr. & Mrs. James Utter. The project is located on
lot #1 in Mitchell Harbor Subdivision, adjacent to Mitchell Creek, in Craven County. The
proposal involved the construction of a 5'-wide by 72'-long pier with a 10' by 32' "L"-
shaped platform at the end and includes the installation of three mooring pilings along
upstream side.
The North Carolina Division of Coastal Management (DCM) has given careful
consideration to your objections and has determined that the project is consistent with
Section .1200 - General Permit for Construction of Piers: Docks: and Boat Houses in
Estuarine and Public Trust Waters. Consequently, the Division issued CAMA General
Permit #26167-C to James & Eileen Utter on December 28, 2000 for the above described
pier. I have attached a copy of the permit for your perusal.
If you wish to appeal this permit decision, you may file a request with the Director of the
Division of Coastal Management, Department of Environment and Natural Resources
within 20 days of the permit decision. If you have any questions regarding this matter,
please don't hesitate to contact Brad Shaver or me at our Morehead City office (252-808-
2808).

Re: Application by Mr/Mrs Jim Utter for boat pier.
Dear Mr. Shaver:
I object to the referenced construction proposed by Mr/Mrs Utter for the
following reasons:
1. The sketch on the reverse side of the notice does not indicate with
sufficent detail the property or boundary line.
2. The sketch has no indication of the center line of the creek or the name
of the creek [assumed to be Mitchell Creek]. Thus, it does not properly
indicate the riparian right boundary as it relates to the center line of the
channel and the property corner at the high water line.
3. The sketch appears to indicate that the pier would extend 104 feet from
the shore line into the creek and I question if this would not interfere .
with navigation.
My position is that Mr/Mrs.Utter should have the riparian right boundary
established by a professional engineer or land surveyor in accordance with appropriate
statues prior to the issuance of a permit. When a permit is issued I would appreciate your
providing me with a copy.
