Please be advised that Fran Law, Broad Creek Construction, has sent on or about
8/23/2001 a certified - return receipt notification of an intention to extend Mr. Duane
Usa's (Moorings Lot #10) pier and "L" out 10 feet to an existing pier line. The cover note
and drawing (please see copy attached) were not accompanied by a notification/waiver
form or written approval notice from C.A.M.A. As 1/4 owner of Moorings Lot #11, slip
1, I am writing this letter to you asking for verification of said "review and approval" and
at the same time registering my objections to the proposed project for the following
reasons.
The accompanying drawing is not accurate. All three piers are shown parallel and roughly
the same length. According to the proposal, extension of 10 feet would put Mr. Usa's "L"
beyond Mr. Wynn's. The actual situation is entirely different. Our Lot #11 outer slip is
approximately 60 feet (seven sections) short of Usa's current "L". Mr. Wynn's "T" is
currently a section or so beyond Mr. Usa's "L". An extension of 10 feet will put Mr.
Usa's slip dead even with Mr. Wynn's. With no change in configuration there is
absolutely no advantage for Mr. Usa and considerable disadvantage for slip owners of Lot
#11.
Also it is important to note that Mr. Wynn's pier is not parallel to Mr. Usa's. In fact they
are on a collision course with further extension. As each owner duels for position they
will find that the "other guy" will be encroaching upon the so called riparian line. A
solution should be found that does not restrict access to any dock/slip.

Please be advised that as one of four owners of Lot #11, The Moorings (Deeded Boat slip
#1) I am declaring that I DO OBJECT to a proposal (apparently resurrected from May of
2000) for moving/changing an existing pier belonging to Duane & Dorothy Usa on
adjacent Lot #10. I also DO NOT WAIVE THE 15' SETBACK requirement. As of
7/25/2001 in telephone discussion with Mr. Andrew J. Pirnik, another 1/4 interest owner
of Lot #11 (Deeded boat slip #2), I was informed that Fran Law, Broad Creek
Construction, had sent on or about 7/24/2001 a certified - return receipt notification of an
intention to make some changes to Mr. Usa's pier/dock.
As can be seen from a copy of the fax from Mr. Pirnik (see attachment), it is not at all
clear what is "proposed" and I object for the following reasons:
1.) There is no specified proposal or description of what is intended.
2.) There are no dimensions on the so called "drawing".
3.) Our recollection is that CAMA rejected a similar proposal last year.
4.) As an adjacent owner my access may be affected adversely.
5.) No proposal has been submitted to The Moorings architectural
committee for approval as per Covenants governing all structures.
I have also been in contact with the remaining two owners of Lot #11, boat slips #3 and
#4. They are Bruce & Deirdra Birnbaum (103 Neuchatel Road, New Bern, NC 28562)
and Geoffrey & Clare Leek (8 Belle Harbour Court, Center Moriches, NY 11934). Mr.
Leek received an identical certified notification/waiver form on or about 7/24/2001. Mr.
Birnbaum did not receive one, nor have I as of this date. For what it is worth, we are
unanimous in objecting to the so called "proposal" as well as declining to waive the

Gentlemen:
I am one of the joint owners of Lot # 11 at The Moorings for which Dwayne
Usa (owner of lot #10) and Broad Creek Construction are asking to move the
location of Mr Usa's existing dock structure.
The drawing submitted has no dimensions on same which should
accompany the proposed drawing.
I do not have an objection to the entire dock being moved further out as long
as same will remain within the established pier line per CAMA's
requirment.
I do object to Mr.Usa's dock being moved closer to the existing dock on Lot
#11 although it is unclear from the drawing that that is an intent.

project proposal by Mr. Duane Usa, your downstream adjacent riparian property owner. The
project is located on lot #10 in the Moorings Subdivision, near Havelock on Clubfoot Creek, in
Craven County, North Carolina. Mr. Usa proposes to extend his pier and "L" an additional
10' farther out into Clubfoot Creek.
Your objections appear to be based on the quality of information provided to you for
review as well as with the angle of the piers in question. It is the Division's opinion that there
was sufficient information submitted to proceed with final permit decision and based on our
review, the 10' or less extension would not encroach into either neighbor's riparian area or
into the 15' setback. The North Carolina Division of Coastal Management has given your
objections careful consideration and has determined that the project is consistent with the
pertinent regulations of the Division. Therefore, on September 24, 2001, the Division issued
CAMA General Permit #28887-C to Mr. Usa for the pier extension.
I have enclosed a copy of the permit for your perusal. If you wish to appeal this permit
decision, you may file a request with the Director of the Division of Coastal Management,
Department of Environment and Natural Resources within 20 days of the permit decision. If

Dear Mr. Leak:
This correspondence is in reference to your July 25, 2001 objection letter to the recent
project proposal by Mr. Duane Usa, your downstream adjacent riparian property owner. The
project is located on lot #10 in the Moorings Subdivision, near Havelock on Clubfoot Creek, in
Craven County, North Carolina. Mr. Usa proposes to extend his pier and "L" an additional
10' farther out into Clubfoot Creek.
Your objections appear to be based on the quality of information provided to you for
review as well as with the dock extension's impact on neighboring docks. It is the Division's
opinion that there was sufficient information submitted to proceed with final permit decision
and based on our review, the 10' or less extension would not encroach into either neighbor's
riparian area or into the 15' setback. The North Carolina Division of Coastal Management has
given your objections careful consideration and has determined that the project is consistent
with the pertinent regulations of the Division. Therefore, on September 24, 2001, the Division
issued CAMA General Permit #28887-C to Mr. Usa for the pier extension.
I have enclosed a copy of the permit for your perusal. If you wish to appeal this permit
decision, you may file a request with the Director of the Division of Coastal Management,
Department of Environment and Natural Resources within 20 days of the permit decision. If
you have any questions regarding this matter, please don't hesitate to contact me at my
