Any person who proceeds with a development without the con-
sent of a CAMA official under the mistaken assumption that the
development is exempted, will be in violation of the CAMA if there
is a subsequent determination that a permit was required for the
development.
The applicant certifies by signing this exemption that (1) the ap-
plicant has read and will abide by the conditions of this exemp-
tion, and (2) a written statement has been obtained from adjacent
landowners certifying that they have no objections to the
proposed work.

This letter is to inform you that I made a site visit to your property at 177 Crow Hill Road
in Otway, Carteret County, on May 16, 2001. At that time, I noticed that Turner Marine
Construction was constructing a pier and t-head from your property into Leopard Creek.
To my knowledge, there was no authorization for this structure. I called Mr. Robbie
Webb of Turner Marine and discovered that he had neither obtained nor seen
authorization for this project. At that time, I asked Turner Marine to stop work until the
situation was resolved. As it turns out, no authorization had been obtained for the
development. Mr. Webb has since submitted a drawing sufficient to indicate that the
project qualifies for a CAMA Exemption, a form of authorization that exempts the
property owner from obtaining a full permit. Additionally, he has submitted signatures
from the adjacent riparian property owners, as is required by law.
This letter serves as your authorization to continue with the development of your pier and
dock, in accordance with the plans submitted on May 18, 2001, and in compliance with
15 NCAC 07K .0203 (enclosed). Please note that this authorization is only as good as the
information submitted. If this information is found to be in error sufficient to result in the
project being found non -compliant with the appropriate guidelines, further enforcement
action will follow. This authorization does not relieve you of the necessity of
obtaining any other federal, state, or local permits. Specifically, you must obtain a
building permit from the Carteret County Inspections Office. In the future, it is
imperative that you pursue and obtain all necessary permits and authorizations
prior to commencing development.

Dear Mr. Webb:
I wanted to take this opportunity to address permit authorization procedures in
light of the most recent General Permit (Permit # 27552-C) issued to your client signed
by you as the agent. The Division of Coastal Management has been given the
responsibility by as many as fourteen other review agencies to issue General Permits in
lieu of every applicant going through the major review process. The General Permit
process is by design intended to expedite permit procedures but does not guarantee an
instantaneous decision and issuance of permits.
The aforementioned permit commanded additional scrutiny based on its location
in relation to the main access canal for one of the most heavily traveled corridors in
Atlantic Beach. You were asked to provide information showing that the project as
planned would meet the conditions of the General Permit. Upon closer review with aids
such as aerial photography, available in the Coastal Management Office, a second site
visit was required to identify where the boatlifts would be located along the channel. It is
not unusual or should not be a surprise for the Division of Coastal Management to
request an applicant or the applicant's agent to stake the location of a proposed structure
in relation to site conditions.
It is important for all conditions of the General Permit to be met to eliminate any
cause for concern from citizens and other resource agencies. For this reason and
stipulated within the General Permit, construction of a project should not be
initiated until a permit is secured from Coastal Management as well as other local,
state, or federal authorization. Please heed this as a notice, that in the future any work
completed without a permit will result in a Notice of Violation and will require the
assessment of a civil penalty and may further require restoration at the applicant's
expense.
I wanted to convey the decision process of a General Permit to you so that you
understand what responsibilities the Division of Coastal Management has in issuing
General Permits. I have enjoyed working with you to date and look forward to working
