This letter and the attachments described below are to serve as the application for a general
permit for the referenced project. The City of New Bern and Rivershore, LLC are proposing to
run a sewer force main consisting of 8" and 10" pipe from the City of New Bern to the future
Rivershore, LLC development. The line will be routed to the south side of Sandy Point Road at
the Neuse River and will be directionally bored under the river to an area next to Old US 17 on
the west side of the river and tied into the existing lift station. The use of the directional bore
under the river should minimize the environmental impact of the crossing in comparison to
dredging the line in.

We have not received authorization from the Division of Water Quality yet, but are awaiting
approval of the permit application that has already been sent in. We are currently working on
obtaining the necessary easement from the Department Of Administration. These two items will
be sent to you upon receipt. Please review the attached drawings and contact me if anything
further is required. If you have any questions, please do not hesitate to call.

In accordance with your application received December 30, 1999, and additional information received
February 25, 2000 and March 7, 2000 we are forwarding herewith Permit No. 17826 dated March 10, 2000, to
the City of New Bern for the construction and operation of the subject wastewater collection extension. This
permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and
limitations as specified therein.
Please pay particular attention to the following construction requirements established by Condition
No. 1 l .f. and Condition 11.2 respectively:
Pressure gauges will be installed on both sides of the Neuse River crossing to monitor the
integrity of the force main, and
Flushing connections at the river crossing to allow periodic removal of solids deposits.
Permitting of this project does not constitute an acceptance of any part of the plans and specifications
that do not meet 15A NCAC 2H .0200 and the Division of Water Quality's Gravity Sewer Minimum Design
Criteria adopted February 12, 1996 unless specifically mentioned herein. Division approval is based on the
acceptance of the certification provided by a N.C. Professional Engineer on Page 6 of the subject permit
application form. It shall be the permittee's responsibility to ensure the plans and specifications meet the
appropriate design criteria and rules. Failure to comply may result in penalties in accordance with North
Carolina General Statute 143-215.6A — 143-215.6C, construction of additional facilities, and/or referral of the
N.C. Professional Engineer to the licensing board.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right
to request an adjudicatory hearing upon written request within thirty (30) days followin; receipt of this permit.
This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC
27699-6714. Unless such demands are made this permit shall be final and binding.

and other applicable Laws, Rules, and Regulations

construction and operation of approximately a 490-GPM pump station with duplex pumps, on -site audible and
visual high water alarms, telemetry, and standby portable generator; approximately 6,414 linear feet of 8-inch
force main and approximately 6,170 linear feet of 10-inch force main to serve the Taylor Development, and the
discharge of 0 GPD of collected domestic and commercial wastewater into the the City of New Bern's existing
sewerage system, pursuant to the application received December 30, 1999, and in conformity with the project
plan, specifications, and other supporting data subsequently filed and approved by the Department of
Environment and Natural Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the following
specified conditions and limitations:
This permit shall become voidable unless the facilities are constructed in accordance with the conditions of
this permit, 1 5A NCAC 2H .0200, the Division of Water Quality's Gravity Sewer Minimum Design
Criteria adopted February 12, 1996, the approved plans and specifications, and other supporting data unless
specifically mentioned herein.
2. This permit is effective only with respect to the nature and volume of wastes described in the application
and other supporting data.
The facilities must be properly maintained and operated at all times.
4. The sewage and wastewater collected by this system shall be treated in the City of New Bern's Wastewater
Treatment Facility (NPDES Permit No. NC0026348) prior to being discharged into the receiving stream.
This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there
is a name change of the Permittee, a formal permit request must be submitted to the Division of Water
Quality (Division) accompanied by an application fee, documentation from the parties involved, and other
supporting materials as may be appropriate. The approval of this request will be considered on its merits
and may or may not be approved.
Construction of the sewers, pump station(s) and force main shall be scheduled so as not to interrupt service
by the existing utilities nor result in an overflow or bypass discharge of wastewater to the surface waters of
the State.
7. Upon completion of construction and prior to operation of this permitted facility, a certification and a
copy of the record drawings (i.e., as -constructed plans) must be received from a professional engineer
certifying that the permitted facility has been installed in accordance with the Division's Gravity Sewer
Minimum Design Criteria adopted February 12, 1996, 15A NCAC 2H .0200, this permit, and other
supporting materials. If this project is to be completed in phases and partially certified, you shall retain the
responsibility to track further construction approved under the same permit and provide a final certificate of
completion once the entire project has been completed. A copy of the record drawings, indicating the
facilities constructed in the phase being certified, shall be submitted with each partial certification. Mail the
Certification and one (1) copy of the record drawings to the Non -Discharge Permitting Unit, 1617 Mail
Service Center, Raleigh, NC 27699-1617.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum
of five years from the date of the completion of construction.
9. Failure to abide by the conditions and limitations contained in this permit or to construct the facilities in
accordance with the conditions of this permit, 15A NCAC 2H .0200, the Division's Gravity Sewer
Minimum Design Criteria adopted February 12, 1996, the approved plans and specifications, and other
supporting data may subject the Permittee to an enforcement action by the Division, in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
10. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal)
which have jurisdiction.
11. The Permittee shall provide for the pump station and force main the following items:
a. Pump on/off elevations located so that 2-8 pumping cycles may be achieved per hour in the pump
station,
b. An air relief valve located at all high points along the force main,
c. A screened vent for the wet well,
d. Fillets located in the wet well at the intersection of the flooring and sidewalls,
e. Three feet of cover (minimum) over the force main or the use of ferrous material where three feet
cannot be maintained,
f. Gauges to monitor the consistency of the force main pressure through the Neuse River crossing,
Cr. Flushing connections to allow periodic flushing of the river crossing to remove solids deposits,
h Sufficient devices which will protect the pump station from vandals, and
i Flood protection if the pump station is located below the 100-year flood elevation.
j Adherence with the following minimum separations:
(i) Storm sewers (vertical) 12 inches
GO Water mains (vertical -water over sewer) 18 inches or (horizontal) 10 feet
(iii) In benched trenches (vertical) 18 inches
(iv) Any private or public water supply source, including any WS-I waters or Class I or Class II
impounded reservoirs used as a source of drinking water 100 feet
(v) Waters classified WS (other than WS-1), B, SA, ORW, HQW, or SB [from normal high water (or
tide elevation)] 50 feet
(vi) Any other stream, lake or impoundment 10 feet
(vii) Any building foundation 5 feet
(viii) Any basement 10 feet
(ix) Top slope of embankment or cuts of 2 feet or more vertical height 10 feet
(x) Drainage systems
(I) Interceptor drains 5 feet
(II) Ground water lowering and surface drainage ditches 10 feet
(xi) Any swimming pool 10 feet
(xii) Ferrous sewer pipe with joints equivalent to water main standards, shall be used where these
minimum separations cannot be maintained. The minimum separation shall however not be less
than 25 feet from a private well or 50 feet from a public water supply well;
12. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the
Permittee shall take immediate corrective action, including those as may be required by this Division, such
as the construction of additional or replacement wastewater collection facilities.
13. NONCOMPLIANCE NOTIFICATION:
The Permittee shall report by telephone to the Washington Regional Office, telephone number (252) 946-
6481, as soon as possible, but in no case more than 24 hours or on the next working day following the
occurrence or first knowledge of the occurrence of either of the following:
a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of
adequate wastewater transport, such as mechanical or electrical failures of pumps, line blockage or
breakage, etc.; or
b. Any failure of a pumping station or sewer line resulting in a by-pass directly to receiving waters
without treatment of all or any portion of the influent to such station or facility.
Persons reporting such occurrences by telephone shall also file a written report in letter form within five (5)
days following first knowledge of the occurrence. This report must outline the actions taken or proposed to
be taken to ensure that the problem does not recur.

This office has completed its review of the erosion and sedimentation control plan for the
referenced 1.7 ± acre disturbance. Based on the information provided, we have determined the
submitted plan for the installation of pipe and a lift station, if properly implemented, will meet
the minimum requirements of the Act. We, therefore, issue this LETTER OF APPROVAL
WITH the following MODIFICATION.
In the event of a conflict between the requirements of the Sedimentation Pollution
Control Act, the NCDOT encroachment agreement and the contract specifications,
the more restrictive requirement shall prevail.
In 1973, the Sedimentation Pollution Control Act (copy available upon request) was
enacted. It established a performance oriented program requiring a project owner or developer
to protect adjoining natural resources and properties, both during and after construction, from the
effects of accelerated erosion. It is YOUR RESPONSIBILITY to understand and comply with
the following minimum requirements of the Act:

following the date of initial approval, if no land -disturbing activity has been
undertaken;
-- a copy of the LATEST APPROVED soil erosion and sediment control plan
must be on file at the job site;
-- a buffer zone, sufficient to restrain visible sedimentation, must be provided
and maintained between the land -disturbing activity and any adjacent
property or watercourse;
-- new or affected cut or filled slopes must be at an angle that can be retained
by vegetative cover•,

-- unless a temporary, manufactured, lining material has been specified, a
clean straw mulch must be applied, at the minimum rate of 2 tonslacre, to
all seeded areas. The mulch must cover at least 75 % of the seeded area
after it is either tacked, with an acceptable tacking material, or crimped in
place;
-- in order to comply with the intent of the Act, the scheduling of the land -
disturbing activities is to be such that both the area of exposure and the
time between the land disturbance and the providing of a ground cover is
minimized;
-- a permanent ground cover, sufficient restrain erosion, must be provided
within the shorter of 30 working or 120 calendar days after completion of
construction or development on any portion of the tract;
-- except in the case of an emergency, a revised erosion and sedimentation
control plan must be submitted to and approved by this office prior to
initiating any significant changes in the construction, grading or drainage
plans; and,

-- this approval is based, in part, on the accuracy of the information provided
in the Financial Responsibilityl Ownership form submitted with the project
plans. You are required to file an amended form if there is any change in
the information included on the form. This approval and the financial
responsibility/liability cited in it does not automatically transfer with a
change in project ownership.
Be advised that to ensure compliance with the approved plan and the program
requirements, unannounced periodic inspections will be made. If it is determined that the
implemented plan is inadequate, this office may require the installation of additional measures
and/or that the plan be revised to comply with state law. (Note: Revisions to the scope of this
project without prior approval of the plan showing the changes can be considered a violation).
Failure to comply with any part of the approved plan or with any requirements of this program
could result in the taking of appropriate legal action against the financially responsible party
(Rivershore, LLC). One option is the assessing of a civil penalty of up to $5000 per day for each
day the site is out of compliance.
In recognizing the desirability of early coordination of sedimentation control, we believe
it would be beneficial for you and your contractor to arrange a preconstruction conference to
discuss the requirements of the approved erosion and sedimentation control plan. It would be
appreciated if you would contact this office to advise Mr. Bill Crew (252-946-6481, ext. 374) of
the construction start-up date, contractor and on -site contact person or, please, complete and
return the attached Project Information Sheet to the above named.
Acceptance and approval of this plan is conditioned upon your compliance with Federal
and State water quality laws, regulations and rules. In addition, the land disturbing activity
described in this plan may also require approval or permitting from other agencies - Federal, State
or local. These could include the U.S. Army Corps of Engineers under Article 4.0.4.

(contact Mr. Bill Moore, 252-946-6481, ext. 264), county, city or town agencies under other local
ordinances, or other approvals that may be required. This approval does not supersede any other
approval or permit.
Please be advised that a temporary rule to protect and maintain existing buffers along
watercourses in the Neuse River Basin became effective on July 22, 1997. The Neuse River
Riparian Area Protection and Maintenance Rule (15A NCAC 2B.0233) applies to all perennial and
intermittent streams, lakes, ponds and estuaries in the Neuse River basin with forest vegetation
on the adjacent land or "riparian area". In riparian areas with existing forest vegetation in the first
30 feet directly adjacent to the stream, the rule prohibits land disturbance, new development and
fertilizer use within the first 50 feet of land next to the water. In riparian areas with forest

vegetation that is less than 30 feet wide, the rule prohibits land disturbance, new development and
fertilizer use within the area that contains forest vegetation (but not the entire 50 foot riparian
