Recommendations
This proposal concerns the construction of 80 feet of bulkhead shoreline stabilization. The
proposed bulkhead alignment location would be an average of 1 ft waterward of the NWL with a
maximum distance waterward of 5 feet beyond the NWL. The maximum alignment is proposed in
the location where the erosion escarpment is within 5 feet of the existing residential structure
pilings. The southern 22 ft of the bulkhead alignment would be located behind all wetlands and
connect to the neighboring lot. The remainder of the proposed bulkhead alignment, extending to
the north, would follow a direct line to the bulkhead on the adjacent lot. For the next 45 feet, the
alignment would cut through the wetland fringe, leaving approximately 2 feet of a 5 to 6 foot
wetland fringe, waterward of the bulkhead. The bulkhead structure would result in the filling of
approximately 160 sf of Public Trust Area, as well as the filling and associated loss of 400 sf of
coastal wetland fringe habitat including Juncus roemerianus and Spartina alterniflora. This filling
activity would remove that associated area of habitat and nutrient removal capacity along this
waterway. The proposed shoreline stabilization and filling activity would result in an increase in
turbidity levels, at least temporarily, along this portion of this waterway. The placement of a
bulkhead structure along this shoreline would probably result in alteration of the shallow water
habitat bottom adjacent to the existing shoreline.
According to standards in the N. C. Administrative Code, Section 7H .0207, bulkheads are
considered water dependent structures and their use to stabilize shorelines and prevent erosion is
acceptable within Public Trust Areas. Shoreline stabilization has also been found to be consistent
with the Division's current buffer rules.
However, based upon 7H .0208(b)(7), bulkheads shall be constructed landward of significant
marshlands or marsh grass fringes. According to 7H .0205 (d), existing Coastal Wetlands shall be
afforded the highest priority of conservation and second priority shall be given to those types of
development which provide water access and cannot function elsewhere.

Therefore, we must determine if the existing wetland fringe is significant. A wetland fringe might
be considered significant if it is large enough to provide a food or habitat source for wildlife or
have a vast enough root system to dissipate wave energy or receive enough regular/irregular
flooding to provide nutrient removal benefits. Since this fringe is within an existing residential
neighborhood where most of the adjacent lots or properties are developed, I believe it is unlikely
this fringe would provide a significant habitat to local wildlife. An average 5 ft wide fringe might
probably have a significant amount of root system remaining to provide some wave energy
dissipation or nutrient removal benefits. However, the documented erosion escarpment is within
5 feet of the existing residential structure in one location and indicates that this fringe is not
providing the necessary stabilization for the existing residential structure from shoreline erosion.
Since it is unlikely that any remaining wetland fringe would provide any of the above referenced
benefits associated with significant marshland fringes and the placement of the bulkhead landward
of the NWL and this fringe would result in placing the wall within 5 feet of the residential
structure, I conclude that it would be consistent with our rules to allow the placement of the
bulkhead as proposed.
In regard to these findings, I have no objection to the proposed development so long as the
following conditions and Notes are incorporated in the subject permit.
11 Prior to the start of construction, the Permittee shall schedule and coordinate a pre -
construction conference that will include DCM staff. The approved bulkhead
alignment shall be staked within 30 days prior to the start of bulkhead construction,
and this alignment shall be consistent with the approved platwork dated August 8,
2000.
2] No work, structures or fill materials will be placed at the work site or in any waters
or wetlands, other than that work indicated on platwork dated August 8, 2000, and
approved by this permit. The bulkhead structure will be constructed prior to any filling
activity, shall be structurally tight, and shall be consistent with the approved, referenced
platwork. All fill material must be free from debris or pollutants, and obtained from an
upland source.
NOTE Any future development on the permittee's property, other than that work
authorized in this permit, may require modification of this permit or the
issuance of a separate CAMA Permit.

Consistency: The proposal is consistent with and not in conflict w/the Dare County
1994 Land Use Plan certified by the CRC on July 29, 1994, amended
January 23, 1998, and amended May 28, 1999.
Overview: The applicant proposes to construct 86 ft. of bulkhead at NWL, plus return and
fill about 4,400 sf. of 404 Jurisdictional Wetlands in the Swan View Shores Subdivision on
Colington Island.
LUP Policy: The Dare County Land Classification Map identifies the site area as "Limited
Transition". Since the site also is within an Estuarine Shoreline AEC, it qualifies for the
"Conservation" classification. The following policies are related to this request:
Coastal Wetlands: Policy 2.1.2 (a) page 52.
"Dare County advocates the use of existing state and federal regulatory programs as
adequate measures for protecting and preserving coastal wetland areas of
environmental concern."
Estuarine Waters: Policy 2.1.2 (b), page 53.
"Estuarine Shoreline development should continue to be managed to protect and
preserve the natural resources of the estuarine waters. In addition, development
located in estuarine waters shall be water -dependent, related to development on the
estuarine shoreline, or an accessory use to a structure located on the estuarine
shoreline."

Consistency: The proposal is consistent with and not in conflict w/the Dare County 1994 Land
Use Plan certified by the CRC on July 29, 1994, amended January 23, 1998, and

Overview: The applicant proposes to place bulkhead along Lot 12, which will tie -into the
bulkhead on Lot 11. Other improvements on Lot 12 include, boat ramp, dock, boathouse, and to
maintenance dredge within the adjacent man-made canal. Anticipated impacts associated with
request include: the filling of about 388 sf. of Coastal Wetlands, filling of 388 sf. of Public Trust
Waters, about 400 sf. of shading, and the disturbance associated with dredging involving 1,900
sf. Public Trust Waters.
Basis for Determinations: The Dare County Land Classification Map identifies the Frisco
Village area within the "Limited Transition" Classification. County policy recognizes that all AEC
areas also qualify for the "Conservation" Classification. Related County policy is as follows:

I have reviewed Environmental Professionals request to "Refine" CAMA Major Permit
#171-00, issued to you for a bulkhead along the Currituck Sound in Monteray Shores PUD, in
Currituck County. The request submitted extends the length of the permitted bulkhead from 51'
to 64'.
Division of Coastal Management has no objections to the change being requested, with one
exception. The "Refinement" will not authorize any work beyond the lateral bounds of your
property. The enclosed survey reveals that the adjacent bulkhead on Lot # 120 does not extend to
your property as originally indicated. The proposed 64' bulkhead would include approximately
three feet of encroachment onto the adjacent property, which cannot be authorized by this permit.
This Refinement will not authorize any encroachment onto the adjacent property, and will result
in the reduction of the bulkhead length from 64' to approximately 62'.
A copy of this Permit Refinement should be kept with the original permit at all times. All
conditions and stipulations of the original permit remain in force under this Refinement except as
altered herein and shown on the attached plan, revised by Division staff and dated, February 21,
2001. The site plan revisions reflect the following changes: 1) deletes a two foot bulkhead
encroachment onto the adjacent property; and, 2) adjusts the 30' buffer based on the location of
normal water level, as flagged by the Division on February 21, 2001.

Dear Mr. Sampson and Ms. Mathis,
This letter is with reference to John Tyler's CAMA Major Permit #171-00. After the Normal
Water Level Line (NWL) was staked by Ms. Mathis and surveyed, we realized the original
bulkhead alignment approved through this CAMA Major Permit was not accurate.
In order to proceed with an accurate survey, we would like to request a refinement to this permit
to realign the proposed bulkhead along the shoreline (from permitted length of 51' to the
refinement length of 64') with a maximum of 12'-15'of disturbance in the 30' buffer for
placement of backfill and tiebacks, and a realignment of the retaining wall extending from the
bulkhead (from permitted 45' to the refinement length of 68'). The total square footage of 404
wetland fill will change from 3,272 s.f. to 2,331 s.f.
Enclosed is a revised plat with the realignment of the proposed bulkhead and return wall with the
approval of this refinement letter.
