This Office has conducted a site visit to lot # 20 in Shell Landing Subdivision for a proposed (30' X 25')
boat basin. This Office finds that there will not be a significant impact to the overall water quality of Cowpen
Creek. The project does need to use some type of cofferdam structure or upland excavating (leaving a plug
until almost complete) to prevent a lot of turbidity from going into Cowpen Creek. With restrictions of limiting
the amount of turbidity, this Office would be willing to approve the project.

Dear Ms. Tarr:
This correspondence is in reference to your letter of objection to a proposed bulkhead by
your adjacent riparian property owner to the northeast, Mr. Lyman Partin. The property in
question is located on lot #20, in Shell Landing Subdivision, within Cowpen Creek, off of
North River, in Carteret County. The proposed project involves the excavation of a 30' X
25' high ground basin and the installation of 100' of bulkhead around the perimeter of the
basin to your common property.
The North Carolina Division of Coastal Management appreciates your concerns for the
environment and has given your objections careful consideration. However, the DCM has
determined that the basin and bulkhead project is consistent with the pertinent regulations
of the Division. Consequently, CAMA General Permit #26975-C was issued to Mr.
Lyman Partin on October 19, 2000 for the basin and bulkhead.
If you wish to appeal this permit decision, you may file a request with the Director of the
Division of Coastal Management, Department of Environment and Natural Resources
within 20 days of the permit decision. If you have any questions regarding this matter,
please don't hesitate to contact me at my Morehead City Office (252-808-2808).

on my side since across the canal is already bulkheaded_ I have inquirod of a number of people in the
immediate area who have knowledge of the water and the land and -especially the resales of baikheadtra
