This letter is in reference to your June 12, 2001 correspondence as an adjacent riparian property owner where
you raised objection to a request from Daryyn Parnhann, owner of lot 81, section 3, Porpoise Place, Hatteras
Colony, Avon, Dare County, located along the shoreline of a man-made canal that connects to the Pamlico
Sound, to construct a bulkhead for shoreline protection along this shoreline. Dennis W. Hawthorn of the
Division of Coastal Management staff was recently onsite and has reviewed the Paruihani's proposal to
construct this bulkhead.
Mr. Hawthorn has reviewed your letter and has noted that you indicated in this correspondence that you did
object to the proposed bulkhead structure. Mr. Havaliorn has reviewed all aspects of this permit request and
has found this proposal to be consistent with T15A. Section 7H.1100, General Permit for Construction of
Bulkhead and the Placement of Riprap for Shoreline Protection in Estuarine and Public Trust Waters.
The specific use standards that apply to bulkheads are found in 15A NCAC 07H.0208(b)(7). In paragraph
(D)(iii) of this rule, it states that the bulkhead alignment must not result in significant adverse impacts to the
property of adjacent riparian owners. It is possible for bulkheads to deflect wave energy to adjacent shorelines
resulting in erosion. However, along than -made canals such as this one where the fetch that contributes to
wave build-ups is limited by the width of the canal, the wave energy to be deflected would in the majority of
instances be minimal. Thus significant adverse impact is not anticipated.
The Division of Coastal Management has given your continents to this proposal careful consideration. It has
been determined that the proposed project is consistent with the appropriate rules and regulations and that all
prerequisite requirements have been satisfied. In this regard, the Division issued a general permit for the
proposed development on July 27, 2001. A coPy of General Permit 428406-A is attached for your records.
If you wish to appeal this permit decision, you must file a request with the Director of the Division of Coastal
Management, Department of Enyirotument and Natural Resources Within 20 days of the permit decision. If
you have any questions regarding this matter, please do not hesitate to contact Mr. Derails Hawthorn or myself

Construction Project
The Division of Coastal Management hereby acknowledges receipt of your application
on June 27, 2001, for State approval for the development of the referenced project. An
initial screening of the submittal package has been conducted. This revealed certain
deficiencies, which must be corrected before the application package can be accepted as
complete. To assist you in expediting the permitting process as much as possible, I am
notifying you of these deficiencies immediately so that they can be quickly corrected to
facilitate the detailed review by the Field Representative.
I am returning the original application package so that the needed changes can be made,
but will retain a copy so that the Field Representative can commence the detailed review.
Please understand that the subsequent detailed review may reveal additional areas where
further information or documentation is required to demonstrate compliance with the
rules directly applicable to the proposed development. If this occurs, you will be notified
of such issues separately by the Field Representative.
Our initial screening has identified the following deficiencies:
Adequate Work Plans or Drawings have not been submitted. Please address the
following items:
■ A Plan View must be submitted that:
- Indicates the Shoreline; while your drawings do this for the
Parnham lot, the shoreline of the adjacent lot to the south has not
been indicated. The potential of this construction to affect the
adjacent shoreline must be evaluated, and therefore should be
indicated on your plat.
- Indicates Fill Areas; your drawing should indicate the both the
lateral and vertical extent of backfill that is proposed for this
bulkhead project.

To expedite our response to your permitting request, we will commence the detailed
review of your application for a permit pending the receipt of the additional information
requested above. However, the statutorily provided 75/150 days allowed for review
cannot commence until such time as we have received a complete application package.
Once your application has been accepted as complete, you will receive a separate
notification letter.
