Any violation of these terms may subject the permittee to a fine, imprisonment or civil action; and may cause the permit to be- come null and void. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. The applicant certifies by signing this permit that 1) this pro- ject is consistent with the local land use plan and all local ordinances, and 2) a written statement has been obtained from adjacent riparian landowners certifying that they have no objections to the proposed work. Moffitt, Director Ms. Betty Dickens Neuhart 8413 Conover Place Alexandria, Virginia 22308 Dear Ms. Neuhart: NCDENR JUN 2 '1 2001 June 25, 2001 This letter is in reference to your May 21, 2001 correspondence as an adjacent riparian property ownerwhereyou raised objection to a request from Joe O'Neill of 1060 Martins Point Road, Dare County, located along the Currituck Sound, to construct a pier and platform along this shoreline. Dennis W. Hawthorn of the Division of Coastal Management staff was recently onsite and has reviewed O'Neill's proposal to construct this pier. Mr. Hawthorn has reviewed your letter and has noted that although you clearly indicated that you did not wish to waive the 15-foot riparian setback, you did not clearly state that you objected to the proposed pier structure. In either event, a waiver of the 15-foot setback would not be necessary to authorize the structure as proposed by O'Neill. Mr. Hawthorn has reviewed all aspects of this permit request and has found this proposal to be consistent with T 15A. Section 07H.1200, General Permit for Construction of Piers in Estuarine and Public Trust Waters. The Division of Coastal Management has given your comments to this proposal careful consideration and has determined that the proposed project is consistent with the appropriate rules and regulations and that all pre- requisite requirements have been satisfied. In this regard, the Division issued a general permit for the proposed development on June 19, 2001. A copy of General Permit 4 14340 A is attached for your records. If you wish to appeal this permit decision, you must file a request with the Director of the Division of Coastal Management, Department of Environment and Natural Resources within 20 days of the permit decision.
