Located within the Straits area of Carteret County, North Carolina. TO: Ms. Terri Barrett CAMA Office NCDE&NR Division of Coastal Management 151-B NC Hwy 24W, Hestron Plaza II Morehead City, NC 28557 As adjacent riparian landowners to the southeast of the planned NCDOT slope and shoreline protection project at Bridge #73 Harker's Island Bridge on NCSR 1335 we have the following concerns: The only riparian access for our properties is through Jane's Creek whose channel runs immediately beside this proposed project. The existing highway and bridge structure has already caused severe shoaling of the channel, resulting in reduced depth and ebb & flow to Jane's Creek. In addition this creek is the only direct flushing connection to the headwater estuaries and nursery ground marshes of Jane's Creek and Eastmouth Bay. Our concerns lie with the direct and indirect effects the rip -rap slope and shoreline protection project will have on the navigability, ebb & flow, and water quality of Jane's Creek and its' estuary. NCDOT and NCDE&NR-CAMA must be able to guarantee to these riparian property owners, that there will be no direct or indirect effects to Jane's Creek, and be willing to correct or improve any future degradation to the channel, its' ebb & flow, or water quality. Hardened structures can cause severe current and wave actions especially during storm events, which result in shoreline erosion, bottom restructuring, loss of vegetation, shoaling, and drastic channel alterations. The channel of Jane's Creek is vital to the vested interest in our properties. These are our principal concerns with the proposed project. Lastly, while our actual property corner is —300 ft south/southeast from the south end of Harker's Island bridge, our deed (Book 872; Pg 168) includes riparian and littoral rights from this property corner, north to the actual bridge structure. This was agreed upon when NCDOT or NC Highway Commission built the original road & bridge structures to Harker's island (Book 306; Pg 499 11/01/1968). While we have no problem with NCDOT maintaining the highway and bridge structures within their 60 ft right-of-way, we do object to any structures outside of their 60 ft riaht-of-wav and anv direct or indirect effects their proiects may have upon our riparian & littoral rights to this property.
