We had planned on closing this past winter and making the transition into our temporary home, which would have required an NPDES discharge relocation (which you have approved). But as you may know, our funding has been reallocated to the Hurricane Floyd flood relief program, and our expansion put on hold. Therefore, we are still operating out of our facility in Pine Knoll Shores. We are confident, however, that our funding will be restored and our construction will move forward sometime within the next year or two. In the meantime, we still have possession of the Atlantic Station leased space, and we are now sub -leasing a portion of it. There is the possibility that we may move ahead with plans to set up animal holding facilities as originally described sometime later in 2000. This could mean that we would then operate holding facilities, and have wastewater discharges, in two locations simultaneously— here at the aquarium and at Atlantic Station. I am writing you regarding this as a form of update, but also to inquire if.any changes or additions to our existing NPDES permit would be required. We would now like to move forward with a CAMA permit to allow us to install the discharge and intake pipes we discussed. Enclosed are the consent letters you requested from the Town of Atlantic Beach and from the Coastal Federation. I have spoken with representatives of each and informed them of our plans. You should have a copy of a drawing we developed showing the locations of the proposed pipes, along with some specifications for those pipes. Please let me know if other supporting materials are needed at this time. I will be happy to fill out any need forms and initiate payment at the appropriate time. Since our meeting, I have met with representatives of the Coastal Federation and the Town of Atlantic Beach, both of which are adjacent property owners, and both have been informed of our plans and have no problem with them. Attached are letters of consent for your review. I will also forward these letters to Ted Tyndall of Coastal Management so that our application for a CAMA permit can get underway. As we discussed, we would like to proceed with the project under our existing NPDES permit. The timetable for use of the Atlantic Station discharge has slipped just a bit, in that we will likely not begin any discharges there until October or November. However, we still will install the pipe late this summer as originally planned. Please let me know if I need to provide you with any additional information, diagrams, etc. I will keep you informed of the status of our CAMA permit as well. The proposed discharge line is adjacent to the Hoop Pole Creek Property, and the proposed intake line would be on the property and in the creek itself. The property know as Hoop Pole Creek is owned by the North Carolina Coastal Federation (NCCF), and is managed under conditions prescribed by the North Carolina Clean Water Management Trust Fund (NC- CWMTF), an existing conservation easement, and a management plan created by an advisory committee. With these guidelines in mind, NCCF does not see any adverse affects to Hoop Pole Creek from the proposed installation (as outlined in your letter of April 22, 1999) of the discharge pipe and the resulting flow on the adjacent property. In regards to your request to install a salt water intake line in Hoop Pole Creek, per your discussion with our education director, Ted Wilgis, the North Carolina Coastal federation does not object to this project under the following conditions: 1) The intake line would be a 2" PVC pipe; 2) The laying of the pipe and the pipe itself would not cause any lasting disturbance to the creek or its shoreline, nor the surrounding wetlands and uplands of the property; 3) The pipe would be hidden or camouflaged and/or marked with a sign indicating that it is aquarium property; 4) The aquarium would attempt to pump from the facility instead of using a gasoline powered pump that would be attached to the end of the pipe; 5) Aquarium staff will contact NCCF before the pipe is laid to confirm its placement; 6) Aquarium and NCCF staff will monitor the intake pipe and its use for any lasting adverse impacts on the creek and the property, and if any impacts are discovered steps will be taken immediately to reverse the impacts. Please let me or Ted know if you have any questions or comments regarding these conditions. I will be in touch with you as soon as we have a lease prepared for signatures. We look forward to this arrangement, and again thank you and Mr. Hull for your contributions toward our efforts. We are also moving forward with our plans to obtain authority to install saltwater discharge and intake lines in the marsh behind the shopping center. Two weeks ago met with representatives of the Division of Environmental Management (Jim Bushardt), the Division of Coastal Management (Ted Tyndall), and Shellfish Sanitation. After hearing our needs and discussing our plans, all three concluded that this installation was permitable. We will be applying for a minor CAMA permit as soon as we receive letters of consent from the adjacent landowners, the Town of Atlantic Beach and the Coastal Federation. I have spoken with Mr. Sealover of the Town, and Mr. Wilgus of the Coastal Federation, and both indicated that this would not be a problem --letters should be forthcoming soon. Also, Mr. Bushardt of Environmental Management suggested that the discharges we will have can be covered under our existing NPDES permit. He will draft a letter for his file that will include language that addresses the temporary relocation of the discharge to Atlantic Station. We are pleased that this project is on track and look forward to further discussing with you the upfitting of the space. The following is my request, as we discussed, for permit coverage under our existing NPDES permit, for this new operation. In August, 1999, the Pine Knoll Shores Aquarium will close to the public so that our $15 million expansion and renovation can begin. During this construction, we plan to move our exhibits and animal holding facilities to Atlantic Station Shopping Center in Atlantic Beach. We expect to be in this location for at least two years. We have met with the owners and discussed our facility needs, and assured them that we would investigate all necessary permits for discharge of husbandry wastes. As a result, we will be working with you regarding the NPDES issues, and as you know, we will be working with Ted Tyndell of Coastal Management regarding any necessary CAMA permits. Ted has already asked us to contact the adjacent property owners to get that process started. Attached is a rough drawing of the Atlantic Station facility location, which features markings to show our proposed discharge line, and a proposed salt water intake line. The holding tanks that we will have at this facility are very similar in size, number, and scope to our current holding tanks which are already covered under our NPDES permit. These hold salt and fresh water fish and reptiles; we do not house any mammals. Most discharges will result from routine water changes (minimum 15% volume per month) and from sand filter back -washes. We propose to run the discharge pipe under the pavement from the building and extend it approximately 15 feet into the upper marsh. The pipe will be 6 inch PVC, and will be fitted with a perforated outlet to disperse the flow. DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES • JJAAMES B. Use of salt water in this fashion would save us considerable costs for dry salt mixtures. The intake line would be 2 inch PVC and would be laid alongside the discharge pipe to the marsh, and then turn and run along the parking lot edge and through the brush to Hoop Hole Creek. This pipe would not need to be buried. Our staff would intermittently (maybe once every week) go into the creek in a small boat with a gas -powered pump, attach to the pipe, and pump salt water back to the facility where it would be stored in large storage tanks. We will discuss the possibility of installing this pipe with the NC Coastal Federation, which owns the property adjacent to the shopping center, since it may require that the pipe actually rest on their property. It is our understanding that the intake pipeline would not be of concern to the NPDES process. Thank you for your assistance and cooperation in this matter.
