Moffitt, Director June 26, 2001 Mr. Buddy Baysden 119 Bogue Drive Newport, NC 28570 Dear Mr. Baysden, I am writing to you with regard to the site visit we made to 4704 Park Drive in Morehead City, NC. My purpose at the visit was to determine the consistency of your proposal, on behalf of Mr. Allen Mims, to construct a bulkhead, and renovate the existing boathouse and docks. As we discussed, the boathouse is currently inconsistent with the CAMA. Given that the cost of the proposed repairs greatly exceeds 50% of the current value of the structure, the development must be consistent with current guidelines. These guidelines require that a boathouse be no greater than 400 square feet in size, have no more than half sides, and dock area be limited to 4 square feet per linear foot of shoreline. Additionally, there is now a 30' buffer from the nhw contour for all non water -dependent activities. This would affect the high ground deck by the boathouse. The alternative to these guidelines is an allowance for non -conforming, development found in 15A NCAC 07J .0211, which deals with the renovation of non -conforming structures. This rule has 4 criteria that follow: (1) the structure will not be enlarged beyond its original dimensions; (2) the structure will serve the same or similar use; (3) there are no practical alternatives for replacing the structure to provide the same or similar benefits in compliance with current rules; and (4) the structure will be rebuilt so as to comply with current rules to the maximum extent possible. I have looked at your proposal for development, and have delineated a line where the bulkhead can be constructed. For the renovation of the boathouse, the non -conforming use standards must be employed. The first two criteria are met. The third is not applicable because you are not proposing to raze and rebuild the structure. The fourth, however, must be met. I discussed the situation with Ted Tyndall, District Manager for this office, and we have determined, the limits of "maximum extent possible" for the proposed development. This determination is based on the development proposed in the plats submitted June 14, 2001. In order to be consistent with the guidelines, and pursue the proposed development, you must 1) remove the bottom half of the boathouse walls (lattice is specifically prohibite 2) it the landward side dock under the boathouse to 6' in width; 3) remove the 5' x 16' deck at the bulk ead to a point 30' landward of the nhw contour, or remove it entirely. If these concessions are made, I can write a permit to allow for the proposed development, namely, the strengthening of the boathouse and the construction of the bulkhead. If I can be of further assistance, please feel free to call. I am attaching the 7H guidelines which govern boathouses and docks, and the 7J guidelines which include non -conforming redevelopment.
