This permit is subject to compliance with this application, site drawing
and attached general and specific conditions. Any violation of these terms
may subject the permittee to a fine, imprisonment or civil action; and
may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit of-
ficer when the project is inspected for compliance. The applicant certi-
fies by signing this permit that 1) this project is consistent with the local
land use plan and all local ordinances, and 2) a written statement has
been obtained from adjacent riparian landowners certifying that they
have no objections to the proposed work.
In issuing this permit the State of North Carolina certifies that this project
is consistent with the North Carolina Coastal Management Program.

This letter is in reference to your correspondence dated June 15, 2001 raising concerns
about a proposed bulkhead replacement by Dr. John E. Carroll, on his property located at 141
Algonkian Drive (SR 1287) Manteo and adjacent to the Roanoke Sound. Mr. Frank Jennings of
my staff has contacted you and Mr. Collins on several occasions regarding your correspondence
and has met with you and Mr. Collins on site to discuss your concerns. As a result of those
discussions concerning the tie-ins to your existing bulkhead and potential impacts to the
adjoining properties, it was explained that your concerns did not rise to the level whereby the
State could justify not issuing the applicant's permit.
The Division of Coastal Management has given youRconcerns careful consideration and
has determined that the project is consistent with the appropriate rules and regulations and that
all pre -requisite requirements have been met. Consequently, the Division has issued a general
permit (copy attached) on August 7, 2001 to Dr. John E. Carroll for a new bulkhead.
If you wish to appeal this permit decision, you may file a request with the Department of
Environment and Natural Resources within 20 days of the permit decision. If you have any
