ENCROACHMENT AGREEMENT
THIS AGREEMENT, made as of this 3`d day of February, 2001, by
and between the Town of Morehead City, North Carolina, a North
Carolina municipal corporation in the County of Carteret, State of
North Carolina, herein called City; and Clifton W. Carey and wife,
Linda S. Carey, of the County of Lenoir, State of North Carolina,
hereinafter called Carey;
WITNESSETH THAT:
WHEREAS, the parties hereto are the owners of adjoining lands
situated in Morehead Township, in the County of Carteret, State of
North Carolina, the lands of the City being Shackleford Street
South of Block 104 as shown on the official Map of City recorded in
Map Book 1, page 139, in the Office of the Register of Deeds of
Carteret County; and the lands of Carey being Lot 6, Block 104
aforesaid; and,
WHEREAS, Carey wishes to construct a pier from in front of the
Carey property into Bogue Sound and will of necessity cross the
right-of-way of Shackleford Street to reach the waters of Bogue
Sound;
NOW, THEREFORE, the parties, in consideration of the sum of
TEN DOLLARS ($10.00), by Carey to City in hand paid, the receipt of
which is hereby acknowledged, do hereby agree that a portion of the
pier may be constructed over and across the Shackleford Street
right-of-way immediately South of Carey's lot and may remain until
and unless City gives notice to Carey to remove the pier from the
right-of-way. Upon notice .from City to remove the pier, Carey, and
their successors, assigns, and personal representatives, at their
own expense will remove the pier and all parts thereof within 60
days of receiving written notice so to do.
It is further agreed that this document shall not create in
Carey any rights, title or interest in the property of City but
shall simply constitute a license to Carey to allow the pier to be

constructed and to remain where it is until City shall require its
removal as herein provided.
This Agreement shall bind and inure to the benefit of the
parties and their heirs, personal representatives, successors and
assigns.
Wherever used herein, the singular shall include the plural,
the plural the singular, and the use of any gender shall be
applicable to all genders as the context may require.
IN TESTIMONY WHEREOF, the parties have hereunto set their
hands and seals as of the day and year first above written.
