Eller 02/09/01 RE: Request for waiver for John Atkins Dear Mr. Eller, Attached is the dravri¢ng of the proposed dock and boat lift for John Atkins at his 768 Island. Road property on Ha.rkers island. The waiver request is for the western or right bf.de vdjaceza lot only. The drawing is exaggerated for clarity to show what is being built. The dock and its I. -:head platform will be slightly West of center in the Atkins lot as the drawing shows, and the lift and catwalks ,,*ill allow a 15' set Back which is really 30' in terms of the minimum distance then> would bd. frorn it to any dock or structure built on the adjacent western or right side lot. Tom Bnthn and I met with CANNA and Alton Best to discuss the [matter at length. What we are. submitting for your consent is what we l;eli-we he for 911 concerns including your two adjacent lots and riparian access. CAMA has recently imposed additional rules concerning setbacks of less than feet. They are requiring a voluntary waiver from the affected adjacent landowner even thom9h the law requires a minimum of 15' of set Lack without a waiver. Otherwise a set of surveys is required that will likely cause severe delays, additional costs, and may end up doing more harm than good regarding the three lots in question, The waiver requested is a one twine waiver only affecting the right or western adjacent lot and is only good for this proposed project; any future projects or changes would have to undergo anetheer permit process and Permission from you or the new owner of the property.
