In fact, the Covenants give no specific requirements for such except to refer to "boathouses" in paragraph 11. 12, page 8 and to specify that the Architectural Control Committee is to approve the plans. The Committee has recommended to the Board and the Board has approved a set of parameters for docks which we believe will extend the overall intent of the Covenants to the design and construction of "docks, piers, moorings, boathouses, lifts, floating docks or similar structures." All such facilities must: l . meet LAMA and County agency specifications and requirements and have the proper approvals in writing. 2. meet the 1S'_pmperty line setback or have the adjacent property owner's waiver in waiting. 3. not exceed the height of single level structure (no tw(>-story structures) a, must have a pitched roof with a maximum rise of 30 inches b_ must not have a flat roof which could be used for people -activities or on -top storage. c. must be acceptable design and construction (i.e., roofing materials to be in keeping with the quality and style of those used on homes in the subdivision). 4. not deviate significantly from the design, shape and size of wdsting docks. The decision to limit boat houses, lift covers and dock roofs to a single level, we believe, is not in contradiction to paragraph 115 F, page 4 of the Covenants which permits two story detached structures on lots, but rather, is in keeping with the intent to limit structures which would interfere with the view of adjoining lot owners. Willis DDS 919-929-2658 p.4 Each lot Owner shall be permitted to build, erect or maintain not more than two detached structures on any lot not exceeding two stories in height to be used as a cabana, gazebo, or utility building; provided further that such detached buildings shall not be used for any activity normally conducted as business. Utility buildings and cabanas shall be located where they do not interfere with the view of adjoining Lot Owners as determined by the Architectural Control Committee....... In general terms, the Committee's position is that although two-story structures may be built can land, the more distant structures on the water which would rise above the deck level (primary living level) of adjacent homes would be an unreasonable imerference of the view of adjacent property owners. We did agree to the proposed plan if reversed putting the covered boat lift on the west side of lot # 25. It does not appear that this reversed plan would obstruct the view from lot # 24. As the view from lot # 24 is straight across the shoreline of lot # 24. Please do not hesitate to call me to discuss at 336-877-1348.
