Dear Mr. Fitzgerald:
The Division of Air Quality (DAQ) has reviewed Anson County Waste Management Facility's
request for an extension to the Tier 2 nonmethane organic compounds (NMOC) sampling and report
submittal deadlines as defined by 40 CFR 60, Subpart XXX and Air Permit No. 09835T03. The request
was submitted to DAQ in a letter dated January 25, 2019, and in a follow-up letter dated January 29, 2019,
both from Juene Franklin of Franklin Engineers and Consultants, LLC on behalf of the Anson County
Waste Management Facility. Your company is claiming multiple force majeure events, including
Hurricanes Florence and Michael in the fall of 2018,repeatedly delayed the landfill gas collection and
control system expansion project. Additionally,when the required Tier 2 NMOC sampling was conducted
on December 27, 2018, one of the two collected samples did not pass the required quality assurance
checks. Therefore, your company has arranged for additional Tier 2 sampling on January 31, 2019, but
needs more time to submit the final sampling results.
Pursuant to 40 CFR 60.8,the DAQ has the authority to evaluate force majeure claims and, if
warranted, grant an extension to the Tier 2 NMOC sampling and report submittal deadlines. The DAQ has
evaluated your force majeure claims and agrees that the delays in completing the Tier 2 sampling at the
Anson County Waste Management Facility were caused, at least in part, by circumstances beyond the
control of the affected facility and its affiliates. Therefore, the DAQ is granting your request to extend the
deadline to February 28, 2019,to complete the Tier 2 NMOC sampling and submit the required NMOC
emission rate report.
The granting of this extension to the specific compliance testing and reporting deadlines does not
relieve your company of the legal responsibility for compliance with any other applicable provisions of
your Title V permit or with any other applicable Federal, State, or local requirements.
