Dear Mr. Cottrell:
On August 29, 2019 Ms. Betsy Huddleston of this office conducted an annual permit compliance
inspection at the W.E. Partners 11,LLC facility in Lewiston,Bertie County. During the inspection she
asked for the monthly biomass tonnages combusted for October 2018 through July 2019. Permit Specific
Condition A.13.requires each criteria pollutant emission from the facility to be less than 100 tons per
consecutive twelve-month period to maintain synthetic minor status. Ms. Huddleston used the provided
tonnages,along with the biomass tonnages in the January 17, 2019 annual synthetic minor report,to
calculate twelve-month rolling carbon monoxide emissions. She discovered that carbon monoxide
emissions for the period of August 2018 through July 2019 exceeded the limit. You confirmed by email
on September 26,2019 that the calculated emission for that period was 100.07 tons.
This synthetic minor exceedance is a violation of Permit Specific Condition A.13. and 15A
NCAC 2Q.0315. Please note that any violation can result in possible civil penalties as per North
Carolina General Statute 143-215.114A. A civil penalty may be assessed against a company who violates
or fails to act in accordance with the terms, conditions, and/or requirements of any permit issued under
