Dear Mr. Davey:
In response to the Notice of Deficiency dated August 8, 2019.
As discussed with Steve Ensley and Chris Scott on Wednesday August 14t" phone
conversation the air permit, equipment list and flow diagram for the Cherokee County Quarry was in
fact missing from its posted location and I accept full responsibility for the oversight and the Notice of
Deficiency.
However, the Riverbend equipment that was on site and was in the process of relocating to
another site has a binder that includes the equipment list, plant flow diagram, monthly dust control
log and operating log. It takes approximately 5 to 7 days depending on the number of pieces of
equipment being used at a site to mobilize to the next site. Ninety percent of the mobile set up had
been moved to our Hayesville location with approximately two to three pieces yet to be moved
remaining at the Cherokee County Quarry at the time of Mr. Ensley's inspection. The binder had
been moved with most of the equipment to Hayesville. I think it unreasonable to expect all equipment
to be moved at the same time or to have the notebook not travel with the equipment from location to
location as that is what I was advised to do by DAQ prior to Riverbend ever operating at any of our
locations.
In conclusion, as a result of the phone conversation referenced earlier we have arrived at
what seems to be reasonable solution to meeting the "Quarry Equipment Reporting" requirement by
creating a binder that includes all Riverbends mobile equipment, flow diagram, equipment list, dust
control log and operating log for each site Riverbend operates that will stay at each site.

Don,
As you'll recall, during out phone conversation yesterday afternoon we believe we've arrived at a reasonable solution to
meeting the "Quarry Equipment Reporting" requirements of Harrison Constructions' quarry permits. It sounds like the
best solution to achieve the objectives of the requirement would be for Harrison to develop and keep a binder at each
permitted site that includes a list of stone processing equipment and a flow diagram showing the configuration of the
equipment for each site. To be sure inspectors can match equipment with the flow diagram, please consider ways to
label mobile equipment so compliance with any applicable NSPS testing or maintenance requirement can be
verified. The binder could also be a place where other related documentation is kept, such as a current air permit,
operation and dust control maintenance logs.
