Box 449 Franklin,NC 28744 SUBJECT: Notice of Deficiency - Recordkeeping Requirements APAC-Atlantic, Inc. - Murphy Facility Murphy, Cherokee County, North Carolina Air Permit No. 08786R08 Facility ID# 2000121 Facility Classification: Small Dear Mr. Mason: On August 1, 2019, Steve Ensley of this office performed an air quality compliance inspection at the subject facility. Various components of portable crushing equipment were observed on site that had not been noted during previous inspections. Mr. Ensley requested a current equipment list, as well as a copy of the air permit. Neither could be located during the inspection. An equipment list and plant diagram were made available by email later that day. However, the portable crushing equipment observed during the inspection was not documented in the equipment list provided. Specific Condition and Limitation No. 9 of Air Permit No. 08786R08 states in part: QUARRYEQUIPMENT REPORTING -As required by 1 SA NCAC 2D.0605, the Permittee shall maintain on-site an equipment list and a plant (or flow) diagram Of all equipment covered under this permit. This letter serves as a Notice of Deficiency to address the Permittee's failure to maintain a current copy of the equipment list on site and available for inspection. Please respond in writing to the Asheville Regional Office by no later than August 29, 2019. Your response should outline the steps that you plan to take or have taken to assure compliance with the air permit requirements. It should be noted that the deficiencies cited in this letter and any additional documented violations could result in the initiation of an enforcement action by this office in accordance with North Carolina General Statute 143-215.114A, which provides for the assessment of civil penalties.
