Box 1620 Dublin, VA 24084 SUBJECT: Notice of Violation Southside Materials LLC- Shelton Quarry Pelham, North Carolina Caswell County 04-1700009-Small Air Permit No. 03370R17 Dear Mr. O'Brien: On May 7 and 21, 2019, Chris Bryant of this office contacted Jim Raines and conducted a compliance inspection of the above referenced facility. During the course of the inspection, Mr. Bryant discovered that the facility had failed to comply with the requirements associated with 15A North Carolina Administrative Code(NCAC) 2D .0501(c), as referenced by Condition A.3 of Air Permit No. 03370RI7. To demonstrate compliance with 15A NCAC 2D .0501(c),the permittee shall maintain on- site an updated equipment list and plant flow diagram of all equipment covered under this permit. Based on records provided during the inspection, the most recent list and diagram had not been updated since January 2007, and several equipment changes have been made since that time. In addition, the facility is in violation of 40 CFR Part 60, Subpart 000 "Standards of Performance for Nonmetallic Mineral Processing Plants,"and 15A NCAC 2D .0524, as referenced by Condition A.8 of Air Permit No. 03370R 17. Specifically, the facility failed to report the actual date of initial start-up and conduct performance testing on Conveyor C-8. Please advise this office in writing no later than June 18, 2019 of the causes of these violations, what was done to rectify the situation, and what will be done to ensure that these types of violations do not occur in the future. Each day that you continue to operate in violation of any federal and state rules may constitute an additional violation. It should be noted that the violations cited in this letter and any additional documented violations of any air quality regulation may be subject to the assessment of civil penalties per North Carolina General Statute 143-215.1 14A or permit revocation as authorized by NCGS 143- 215.108(b)(3).
