REGAN S'ecrelmy � - MICHAELA.ABRACZINSKAS NORTH CAROLINA Direcmr Environmental Quality 29 July 2020 Mr. Charles Horne, Owner Hornwood Inc. 766 Hailey's Ferry Road Lilesville,NC 28091 SUBJECT: Notice of Deficiency: Installing an Unpermitted Air Pollution Control Device NCGS 143-215.108 Hornwood Inc., Air Permit No. 04888R14 Lilesville, Anson County,NC 06/04-00009 Fee Class: Synthetic Minor Dear Mr. Horne, On 14 July 2020, Jeffrey Cole, of the NC Division of Air Quality, Fayetteville Regional Office (DAQ FRO) received an email from Mr. Dale Kelly asking for guidance in completion of forms for an air quality application to install a new electrostatic precipitator(ESP). On 17 July 2020, Mr. Cole spoke with Mr. Kelly and during that conversation Mr. Kelly stated that a concrete foundation had been poured and the base for the cooling tower (a component of the ESP) had been installed on the foundation. Mr. Cole advised Mr. Kelly to immediately cease construction of the ESP until and unless he obtained an air permit modification. NCGS 143-215.108 states that "...no person shall...alter or change the construction or method of operation of any equipment or process from which air contaminants are or may be emitted...unless that person has obtained a permit for the activity from the Commission and has complied with any conditions of the permit... " By installing the concrete foundation and base for the cooling tower prior to obtaining a permit,you have deviated from the requirements of NCGS 143-215.108. As stated in the subject above, this letter represents a Notice of Deficiency for the cited deviation. Be aware that future deviations from air quality regulations could result in issuance of a Notice of Violation and may be subject to the assessment of civil penalties according to North Carolina General Statute 143-215.114A. Additionally, the Division strongly recommends that you carefully examine your current permit stipulations.
