Dear Mr. Archer,
Your current air permit, identified above, includes a stipulation requiring that a report be
submitted to this Office no later than 1 March every year: condition A.9 15A NCAC 02D .0803
"Exclusionary Rule Requirement." The report was received in this office on 10 June 2020.
Once the report is reviewed, a compliance determination, based upon the content of the report,
shall be made. This letter is to officially inform you that by submitting the required report after
the due date you deviated from your air permit and from 15A NCAC 02D .0803 "Exclusionary
Rule Requirement."
As stated in the subject above, this letter represents a Notice of Deficiency for the cited
deviation. Be aware that future deviations from air quality regulations could result in issuance of
a Notice of Violation, and may be subject to the assessment of civil penalties according to North
Carolina General Statute 143-215.114A.
Additionally, the Division strongly recommends that you carefully examine your current
