Box 718 Wadesboro,NC 28170 Subject: Notice of Violation: GS 143-215.108A- Operating Without a Permit Valley Proteins, Inc. - Wadesboro Division Facility ID No. 0400034 Permit Number: 06467T20 Anson County, Wadesboro,NC Fee Class: Title V Dear Mr. Hanks: On February 28, 2020,the Fayetteville Regional Office Division of Air Quality (FRO DAQ)received an email from you stating that a control device malfunction had occurred at your Wadesboro facility. You noted that you discovered during an inspection on February 27, 2020, that the fan on the Venturi Scrubber(CD-C-1) had failed. Venturi Scrubber C-1 is currently permitted as a control device for the following sources: • Feather and Blood Rendering process consisting of: One rotary steam tube dryer(ES-E6), One feather hydrolyser (ES-E9) and One feather press (ES-El0) • One three stage slurry system evaporative condenser cooker with post heater forced circulation chamber on 1st stage (ES-El) • One 320U cooker (ES-E7) • Press/centrifuge process (ES-E8) You also stated that,until a replacement fan was acquired, you diverted the flow of non-condensables from the Venturi Scrubber C-1,to your facility's Crossflow Scrubber (CD-C-8). Additionally, you stated via email on April 24, 2020 that Venturi Scrubber C-1 was returned to operation on March 1, 2020. Your current air permit 06467T20 states that "...The construction of new air pollution emission source(s) and associated air pollution control device(s), or modifications to the emission source(s) and air pollution control device(s) described in your permit must be covered under an Air Quality Permit issued by the Division of Air Quality prior to construction unless the Permittee has fulfilled the requirements of GS 143-215-108A(b) and received written approval from the Director of thee Division of Air Quality to commence construction. " Operation of the Crossflow Scrubber C-8 for control of the non-condensables from the emission sources listed above is not currently permitted, and therefore is a violation of GS 143-215.108A. As stated in the "subject' above, this letter represents a Notice of Violation for the cited violation. The above violation and any future violation of an air quality regulation are subject to the assessment of civil penalties per North Carolina General Statute 143-215.114A. Please submit a written response to this office no later than July 6, 2020,including a permit modification application for the new control scenario.
