Dear Mr. Long:
On 9 April 2020, Christel Compton of your staff called Greg Reeves, with the
Fayetteville Regional Office of the Division of Air Quality (FRO DAQ), to report that your
facility had a deviation of your current air quality permit. Ms. Compton stated that facility
personnel had discovered, during an environmental audit, that the operating parameter for the
scrubbing liquid flowrate in the Wet Particulate Scrubber (ID No. NCD-R2) associated with the
Lime Slaker (ID No. NS-R2) was not in compliance with the minimum flowrate as required in
the facility's air quality permit. Ms. Compton indicated that this deviation from the permit
requirement was due to incorrect information that was submitted with the air permit application
when this equipment was added to the air quality permit. She indicated that the scrubber was
being operated as designed and that the scrubbing liquid flowrate was being maintained as
recommended by the manufacturer of this equipment.
Specific Condition and Limitation 2.1.F.l.c of your current permit requires, in part, that
"...The scrubber shall be operated to ensure the scrubbing liquid flow rate is greater than
2.9 gallons per minute. The Permittee shall be deemed in noncompliance with 15A NCAC 02D
.0515 if the scrubber liquid flow rate is not maintained above the prescribed limit... " Failure to
maintain the scrubbing liquid flowrate at greater than 2.9 gallons per minute is a violation
of 15A NCAC 02D .0515.

As stated in the "subject" above, this letter represents a Notice of Violation for the above-
cited violation. This violation and any future violation of an air quality regulation is subject to
the assessment of civil penalties per North Carolina General Statute 143-215.114A. In addition,
each day of continuing violation after written notification from the Division of Air Quality shall
be considered a separate offense. Please be advised that neither this letter, nor any subsequent
action, absolve you from responsibility for any violation or damage to public or private property
or from any enforcement action available to this agency.
Please submit a written response to this office by 1 May 2020. This response should
include the submittal of an air permit application requesting modification of the minimum
scrubbing liquid flowrate to conform to the scrubber manufacturer's recommendations. In your
response, please detail what steps you have taken, or plan to take, to ensure compliance with the
cited requirements and the date by which you anticipate achieving compliance.
Also note that this deviation from permit conditions will need to be reported on your
quarterly deviation report due no later than April 30, your semi-annual report due no later than
July 30, and should also be listed on your Annual Compliance Certification report for calendar
year 2020 due no later than March 1, 2021.
We appreciate your immediate attention to these environmental concerns. The Division
strongly recommends you carefully examine your current air permit stipulations. If you have
